Explaining a Surge in IPR Filings: Uncertain Design Rights and Learning Their Boundaries in the Finnish Sauna Heater Market

We present a case study of a surge in design right filings in an industry transforming from technology-based to design-based competition. The motives for and outcomes of filing, and how these changed over time are discussed. We go on to explore the events, which offered the agents opportunities to update their beliefs about the scope of design right protection. We find that filing motives change from specific protection goals to freedom to operate over time. We also find that the actors faced several, but sometimes contradictory, learning opportunities. This article is focused on the Court's decision in Hornbach-Baumarkt (Case C-382/16) (Hornbach) which is an important clarification of the conditional compatibility of arm's length-based domestic transfer pricing legislation with the freedom of establishment. Hornbach follows and confirms the previous doctrine formulated in SGI (Case C-311/08). The decision did not follow Advocate General's approach, which would have denied comparability of domestic and cross-border situations in transfer pricing cases and, hence, prevent scrutiny of domestic transfer pricing legislation under the fundamental freedoms. By the ‘Rule of Law’ I mean a set of formal and institutional features the law may possess in varying degrees. These features define an ideal, which laws have traditionally been expected to live up to. One of these features is publicity. Part of what constitutes the Rule of Law is the requirement that the laws should be public. This is the subject of this paper. In this paper I argue that Rawlsian Law of People (LP) is much more useful to the debate on international distributive justice than it is commonly assumed by many leading political philosophers (Pogge, Nussbaum, Sen, Beitz, Singer). I will show: 1) that these criticisms are misleading, insofar as they do not take the concept of basic structure seriously, and they reduce LP to an instance of ethical statism or of acritical acceptance of cultural pluralism; 2) that the basic domestic structures, and the principles that govern them, depend on the law of peoples and its principles as well. In the pages of La Scienza della Legislazione the Neapolitan writer shows the tendency to develop a utilitarian investigation which pays attention to the judgements individuals make over social phenomena at the margin point.
