Arguments and counter-arguments in the debate to decriminalize some forms of incestuous relations in Poland
2018
This study explores argumentation and counter-argumentation patterns emerging from a corpus of readers’ comments found below-the-line of over twenty-five online articles on the subject of incest, the current legal sanctions against it and the possibility to decriminalize consensual incestuous relations between adults in Poland. The comments have been coded line-byline for the types of positioning and argument premises using Atlas.ti software. Using the framework for argument analysis according to underlying premises, the comments were analyzed with respect to stance taken, practical reasoning conducted, and salient rhetorical strategies applied. They are subsequently correlated with the dis…
Recognitive Arguments for Workplace Democracy
2020
In this paper we have a twofold aim. First, we wish to show that commitments within recognition theory lend themselves readily for arguments for workplace democratization. This is done through arguing that authoritarian forms of labour organization go against fundamental recognitive needs, generating injustice and unnecessary social suffering that could be ameliorated through giving workers a proper voice. In conjunction with this aim, we offer a defence of the idea of workplace democracy from the perspective of recognition. Our goal is not to override other arguments for workplace democracy, but rather to provide additional reasons to democratize working life.
Prowadzenie działalności gospodarczej jako podstawa wygaśnięcia mandatu radnego w świetle orzecznictwa sądowoadministracyjnego – wybrane problemy
2020
The paper presents the legal basis for the termination of a councillor’s mandate, which comes from general elections, in a situation when he finds out that he conducts business activity on the property or using the property of the commune in which he obtained the mandate. The positions of administrative courts expressed in this regard as a result of complaints about resolutions or supervisory decisions, by which the councillor’s mandate was terminated due to the premise of conducting business activity, were presented.
The Role Of Elites In The Diffusion Of Social Norms Of Humanitarianism
2019
Certain social norms evolve without punishment as conventions that do not adversely affect society. In this paper, we depart from the notion that humanitarianism is one such social norm, where peer pressure may be the only type of punishment that encourages individuals to conform. Using an agent-based modeling approach, we examine the role that networked elites have in diffusing a non-punishment-enforced norm through an artificial society. The model considers norm advocates who promote a norm of humanitarianism, elites who have wide networks to spread the new norm, and general individuals who evaluate the norm pushed from elites and adopted by their peers. The study finds that, regardless o…
The Egalitarian Quality of Lottocracy
2019
Abstract. Recently, political models which employ lottery-selection instead of ballot voting have been proposed. Proponents argue that such lottocratic models can improve the representation of the population and reduce undemocratic influences. In this paper, I argue that these proposals also satisfy the egalitarian requirement of democracy. I claim that having an equal chance to be selected by lot is equally egalitarian as having an equally weighed vote for two reasons: first, having a chance to be selected by lot satisfies the requirement for political justice better than electoral democracy and second, it provides citizens with equal political influence and not merely equal impac…
About Applications of the Fixed Point Theory
2017
AbstractThe fixed point theory is essential to various theoretical and applied fields, such as variational and linear inequalities, the approximation theory, nonlinear analysis, integral and differential equations and inclusions, the dynamic systems theory, mathematics of fractals, mathematical economics (game theory, equilibrium problems, and optimisation problems) and mathematical modelling. This paper presents a few benchmarks regarding the applications of the fixed point theory. This paper also debates if the results of the fixed point theory can be applied to the mathematical modelling of quality.
EXPANSION OF GLOBAL RULE BY LAW ENFORCEMENT: COLOMBIA’S EXTRADITION EXPERIENCE, 1999–2017
2018
We argue that transnational criminal law has enacted a global rule by law enforcement agencies, at odds with the rule of law. Mutual legal assistance agreements (MLAA) allow exporting law enforcement practices without proper judicial oversight. Consequently defendants required in extradition are exposed to abuses, as illustrated here with extradition cases from Colombia to the United States of America (USA) in the past decades. Based on the critical review of documental and statistic information coming from official and independent sources in the U.S. and Colombia, this article pinpoints specific shortcomings that affect due process and fair trials in the case of extradited defendants. Conc…
Open dialogue as a human rights-aligned approach
2019
Throughout the last 20 years, the human rights perspective has increasingly developed into a paradigm against which to appraise and evaluate mental health care. This article investigates to what extent the Finnish open dialogue (OD) approach both aligns with human rights and may be qualified to strengthen compliance with human rights perspectives in global mental health care. Being a conceptual paper, the structural and therapeutic principles of OD are theoretically discussed against the background of human rights, as framed by the Universal Declaration of Human Rights, the UN Convention on the Rights of People with Disabilities, and the two recent annual reports of the Human Rights Council…
