Análisis geodemográfico y planificación territorial en España

This article studies the current role of geodemographic analysis in Spanish spatial planning; its importance, gaps and problems. This is done both from a theoretical and planning perspectives. The theoretical perspective studies the references to the population in the legal norm of the several forms of planning, and in particular in the very recent Autonomous Regions' laws. The planning perspective refers to the specific spatial plans that have been aproved. The article identifies three types of spatial planning: urban planning, town and country planning and environmental planning. Therefore, excluding the sectorial planning with spatial incidence.

Deficiencies of regulation of euthanasia in legal acts of foreign countries

Today in most countries the practising of euthanasia is not permissible and as in any case of a criminal offence, which endangers the life of a person, criminal liability applies here. Self-pathologizing, self-condemning, self-liberating: Youths' accounts of their ADHD-related behavior

This study analyzes the discursive construction of attention deficit hyperactivity disorder (ADHD) and self in relation to a socioculturally shared understanding of moral norms. Thirteen Finnish youth aged 11 to 16 diagnosed with ADHD were interviewed during this discourse analysis study. The youth accounted for their culturally undesirable behavior, performance and traits through three different types of accounts: (1) externalizing personal responsibility due to a compelling medical condition, (2) internalizing personal responsibility through moral self-condemnation, and (3) distancing oneself from the socially imposed stereotypes and stigmas related to ADHD. The paper deals with the “conventionalist turn” in legal positivism in relation to the matter of the duty to obey the law and legal normativity. The paper deals with the structural vagueness of the legal measures enacted by the Italian legislator to manage the Covid-19 pandemic. Can we demand more certain norms? Is personal liberty taken in due account by the legislator? Starting from these and similar questions, the paper proposes a reconstruction of the law and of the underlying legal ideology of contemporary constitutional States.

The author critically discusses some main points of Tommaso Greco’s book La legge della fiducia. Greco distinguishes two models of law – the fiduciary model and the anti-fiduciary one – and supports the first model with good arguments. This review, while endorsing Greco’s conclusions, emphasizes some reason for perplexity and claims that the anti-fiduciary model of law helps to maintain a critical attitude towards the law.

This chapter seeks to explain and evaluate Shapiro’s theory of legal interpretation, as it is outlined in his recent book ‘Legality’. More specifically, in the following I will try to provide (a) a reconstruction of Shapiro’s theory of legal interpretation, as it is developed in ‘Legality’; (b) an assessment of this theory of interpretation on its own terms (i.e. its internal coherence, its overall persuasiveness); and (c) an evaluation of the compatibility of this theory of legal interpretation with the general project of ‘law as plan’.
