Nel quadro dell’esperienza della «Clinica legale per i diritti umani» dell’Università di Palermo (Cledu), il contributo tratta di alcune azioni specifiche condotte nei suoi primi anni di lavoro nell’ottica della costruzione di un “modello” di intervento sistemico, per poi descriverne la necessaria rimodulazione in risposta ai veloci mutamenti politico-normativi del periodo più recente. Sarà così possibile porre in luce alcune caratteristiche dell’approccio clinico-legale nell’Italia contemporanea, e del ruolo del giurista ad esso connesso.

In Palermo, the Law department and a poor bazar of used things share the same square. Even if so closed, the academy and the market ignored and inspect each other with a mutual suspect for a long time. This happened as long as in an academic course an experiment of collaboration between students and merchants has been launched. The aim was to look at the right from the margin and to rewrite the rules together. The produced regulation draft has been used by the Municipality to make the market official. From this experience emerges an idea of university epistemologically humble, able to renounce to the title of knowledge’s monopolist and to activate processes of knowledge co-creation.

Il tema dell’educazione giuridica presuppone che si risponda alla domanda “che cos’è il diritto?”. Come questa domanda ammette risposte diverse, a seconda dei tempi, dei luoghi e dell’ideologia di chi risponde, allo stesso modo non esiste un modello unico, o un ideal tipo, di educazione giuridica. This study is primarily concerned with the security of transactions and contracts in contexts in which there is more than one legal system - in bijural (or multijural) societies - and with the contribution that bijural lawyers can make to the security of transactions and contracts, that is with the productivity of bijural lawyers. Geneza Case Method i jej wpływ na kształt amerykańskiej filozofii prawa

Artykuł omawia Case Method – dominującą metodę edukacyjną stosowaną w amerykańskich szkołach prawa, która polega na nauczaniu prawa poprzez analizę orzeczeń sądowych, stworzoną w latach 70. XIX w. przez Christophusa Collumbusa Langdella. Langdell postrzegał prawo jako naukę, podobną do fizyki czy chemii, a więc jako uporządkowany system obiektywnej wiedzy. Stworzona przez niego metoda nauczania służyć miała przygotowaniu osób zajmujących się prawem w sposób naukowy. W artykule przedstawiona została koncepcja prawa Langdella, oraz wpływ, jaki jego metoda nauczania wywarła na nurty amerykańskiej filozofii prawa – klasyczną jurysprudencję oraz realizm prawniczy.

El objetivo de este texto es proporcionar una reflexión sobre la forma de evaluar el aprendizaje de los alumnos de derecho. Se presenta la evaluación como un acto que puede ser entendido en términos de justicia y que, como tal, plantea al docente complejos dilemas. Con el ánimo de contribuir a la resolución de dichos dilemas y, desde un enfoque jurídico-filosófico, se propone la aplicación de tres principios: de legalidad, de igualdad y de revisión de los actos jurídicos. Dichos principios proporcionan un marco conceptual básico sin el cual la evaluación difícilmente podrá ser considerada justa.
