Legal aspects of forensic DNA analysis in Germany

DNA analysis may be carried out in cases of civil law (e.g., in cases of disputed paternity) as well as of criminal law (e.g., a case of murder). This overview will concentrate on DNA analysis in the context of criminal law. DNA typing of forensic stain samples is generally carried out in laboratories of the Police and of University Institutes of Legal Medicine. The police laboratories are usually part of the State Criminal Offices (Landeskriminalamt, LKA) or of the central Federal Criminal Office (Bundeskriminalamt, BKA). Although palliative care is one of the main arguments among the opponents of euthanasia, the individual medical activities implemented within it are not always evaluated unequivocally. We here report a case involving a 21-year-old female, found dead in a central square of a city in the south of Italy. Initial evidences and circumstances were suggestive of a death associated with a sexual assault. Two peripheral blood and two vitreous humor samples were collected for the purpose of gamma-hydroxybutyric acid (GHB) testing from the dead body at two different post-mortem intervals (PMIs): approximately 2 (t0) and 36 (t1) hours. The obtained results showed that, between t0 and t1, there was an increase of GHB concentrations in peripheral blood and vitreous humor of 66.3% and 8.1%, respectively. Abstract Whipple Disease is a rare chronic multi-systemic disease caused by the ubiquitous environmental Gram-positive bacterium Tropheryma whipplei . It can be fatal if untreated. Here we describe the fatal outcome in a 27-year-old Caucasian female patient with a three-month history of persistent fever, anemia, weight loss and diarrhea. The final resolution of the diagnostic process was only reached after the patient’s death thanks to autopsy. Nowadays, the use of molecular biology in forensics has made it possible to identify human victim and sometimes even the circumstances under which the death occurred through. In our case, a corpse of a 50-years old man with a gunshot wound was found in the woods. The suspected murderer declared that it had been a hunting accident while he shot a wild boar. During the autopsy, a bullet (Borra-bullet Gualandi, 32 gr) was found in the abdomen of the victim.
