Simplified restructuring proceedings in Poland as an example of anti – crisis regulation due to the COVID-19 pandemic

Summary The study discusses new legislative anti – crisis solutions adopted in Poland in connection with the COVID – 19 pandemic. The Polish legislator decided to introduce the so-called simplified restructuring procedure. This happened in the face of the expectations of both the jurisprudence of law and practice. On the one hand, the simplified restructuring procedure (the fifth independent type of restructuring procedure for an entrepreneur in Poland) allows for a quick, cheap and simplified conclusion of an arrangement with creditors outside the court, then approved by the court. In the national legal system, the legal debate highlights a particular attention to the subject of the territorial government, with respect to which the fourth generation regional legislators have experimented with new tools and new legal models, enhancing the participation of citizens in decision-making processes. In this context, the codification of a "city law" is discussed which, in the analysis carried out, is deepened by verifying the contents of the regional disciplines compared, which demonstrate, also, the absence of adequate valorisation of cultural heritage in local public policies.

The article proposes a comparison between the thought and works of Adam Smith and Gaetano Filangieri, two of the greatest exponents of European Enlightenment. We can find some important coincidences in their profiles. Smith and Filangieri met with outstanding international success and their works were translated into most known languages. Both were the main representative scholars of their respective schools: Scottish and the Neapolitan. The Latvian constitutional system is based on the principle of State continuity after the Soviet occupation, and this is reflected in the reinstatement of the 1922 Constitution (Satversme). Unlike other constitutions in the post-communist area, it is characterised as a laconic and predominantly procedural constitution. Ha previsto la possibilità di impugnare una sentenza definitiva di assoluzione per omicidio o crimini internazionali, qualora – in base a nuovi fatti o mezzi di prova – emergano “ragioni stringenti” per una condanna. La riforma ha già sollecitato dubbi di legittimità costituzionale e, per la sua rilevanza, suscita varie riflessioni.
