El Estado de Alarma y el uso del Real Decreto Ley para modificar normas tributarias

[EN] The health crisis produced by COVID-19 led to the declaration of the state of alarm by means of Royal Decree 463/2020, of March 14. From that moment, and as a consequence of the measures adopted, among which were: the suspension of the opening to the public of the premises and retail establishments; limiting freedom of movement; and the suspension of administrative terms, the Government proceeded to issue a series of Royal Decree-laws that affected the financial sphere. The object of this study is the analysis of said normative instrument and its constitutional fit when modifying the tax laws within the aforementioned state of alarm.

The European Court of Human Rights (ECtHR) has recently condemned the Spanish State for an infringement of the third article of the European Convention of Human Rights. As a result, the number of condemns to the Spanish State have increased to ten due to violation of the procedural limb of the mentioned article. In other words, because of the non-effective investigation of possible torture cases. The main objective of this paper is to expose the cases and the doctrine that ECtHR has established around this obligation derived from the prohibition of the torture.

The article analyses a recent significant case in the Court of Justice of the European Union on the extent of compulsory insurance in the field of motor insurance. The judgment delivered by the Grand Chamber of the CJEU on 04 September 2018 clarifies the obligation to conclude a motor insurance contract in a situation when a motor vehicle is no longer intended to be used in road traffic. Glioblastoma (GBM) is the most frequent and malignant primary brain tumor. Conventional therapy of surgical removal, radiation and chemotherapy is largely palliative. BRCA1/BRCA2 rearrangements and CHEK2 common mutations are infrequent in Italian male breast cancer cases

Male breast cancer (MBC) is a rare and poorly known disease. Germ-line mutations of BRCA2 and, to lesser extent, BRCA1 genes are the highest risk factors associated with MBC. Interestingly, BRCA2 germ-line rearrangements have been described in high-risk breast/ovarian cancer families which included at least one MBC case. Germ-line mutations of CHEK2 gene have been also implicated in inherited MBC predisposition.
