L'homosexualité et la constitution de la famille : situations française et européenne

2016

The 2013-404 law of 17 May 2013 which opened up the possibility for people of the same gender to get married shows a turning point for the family rights in France. This law, sometimes described as a real tsunami, is the outcome of taking into account the homosexuals' claim for starting a family. Before 2013 the French right did not allow a homosexual couple to be a homoparental family. It did not authorize people of the same gender to get married. Moreover Assisted Reproduction is only reserved to heterosexual couples and Gestation for Others is strictly forbidden in France. This seemingly constrained consensus on the non-legal recognition of the homosexual family is reinforced by the Europ…

A proposito di un'interessante interpretazione della "appellatio mere evidenter dilatoria" e del ricorso all'armonizzazione ex can. 1691, § 1 a tutel…

2020

About an interesting interpretation of the “appellatio mere evidenter toria” and the recourse to the warning ex can. 1691, § 1 to safeguard “bonum familiae” The Rota Romana, with the decree under comment, once again deals with the issue of the merely dilatory appeal, introduced by the 2015 reform of the matrimonial process, which is still waiting to find a consolidated jurisprudential opinion that defines its uncertain applicative outlines. The solution proposed by the Rota is especially noteworthy for its appreciable attempt to achieve a jurisprudential balance between the right of defence that is expressed in the appeal and the equally remarkable right to have a speedy settlement of a tri…

LGBTIQ+ break-up assemblages : At the end of the rainbow

2020

This article explores Finnish LGBTIQ+ people’s break-ups. The long battle for equal rights has placed LGBTIQ+ people’s relationships under pressure to succeed. Previous studies argue that partners in LGBTIQ+ relationships try to appear as ordinary and happy as possible, and remain silent about the challenges they face in their relationships. Consequently, they may miss out on opportunities to receive institutional and familial support. This study aims to move beyond recurrent frameworks that take the similarity or difference between LGBTIQ+ relationships/break-ups and mixed-sex relationships as a predefined point of departure. The analysis draws on ethnographic observations of relationship …

Agreements regarding the property relations of transnational couples and their effects under the application of the twin regulations

2021

It is a true and verifiable fact that the family institution has evolved over recent decades in Europe and throughout the world, but not uniformly or at the same time. This is because it is influenced by social and cultural connotations specific to each State. All of which are respected under EU Regulations 2016/1103 and 2016/1104. This work analyses the Twins Regulations, that gives the couples the possibility of choosing the jurisdiction (art. 7) and applicable legal system underpinning the property consequences of the marriage and registered partnerships (art. 22.1). However, we try to show you these rules absolute freedom of choice is not granted to the parties, because this freedom is …

Zagadnienie węzła małżeńskiego w doktrynie katolickiej a perspektywa zielonoświątkowa. Studium porównawcze wybranych elementów nauczania

2017

Pentecostalism is the most evolving Christian movement in the contemporary world. Some churches of this tradition have been engaged in a dialogue with the Catholic Church sińce 1972. Solidarietà post-coniugale, assegno di divorzio e autonomia privata

2021

The essay examines the issue of the divorce allowance from the perspective of post-marital solidarity, critically analyzing the outcome of the crypto-indissolubility of marriage that emerges from the consolidated reading of the relative obligation as tendentially without a final term.
