Artykuł podejmuje problem obsadzania mandatów bez głosowania w wyborach do rad gmin w gminach liczących do 20 tys. mieszkańców. W stosunku do wyborów z 2014 r. liczba takich przypadków wzrosła w 2018 r. o 77%. Purpose: To investigate the possible association between ventilatory settings on the first day of invasive mechanical ventilation (IMV) and mortality in patients admitted to the intensive care unit (ICU) with severe acute respiratory infection (SARI). Materials and methods: In this pre-planned sub-study of a prospective, multicentre observational study, 441 patients with SARI who received controlled IMV during the ICU stay were included in the analysis. The paper deals with Paul. 5 quaest., a well-known text on subject of innominate contracts. The author comes to the conclusion that the current version of the text is largely interpolated. At least for § 5, the concession of the contractual action must be attributed to Justinian’s compilers. Great caution is required for § 4, although the use of the agere praescriptis verbis is to be excluded for relationships involving a factum, quod locari non possit: for such relationships, the use of the the actio de dolo or actio in factum must be assumed, as appropriate.
