Neuroética: bases para la introducción de la neuroimagen en el proceso judicial penal

En el presente trabajo se efectúa una aproximación general a los reparos éticos que la investigación neurocientífica plantea, especialmente respecto de sus usos extralimitados en el proceso penal. Así pues, con el objetivo de regular un uso adecuado, respetuoso con los principios generalmente aceptados en el ámbito biomédico, se desarrolla una propuesta de regulación ética de esta materia que preceda a su uso probatorio en el ámbito forense.

BACKGROUND According to Potter’s point of view, medical ethics is the science of survival, a bridge between humanistic and scientific culture. The working out of judgements on right or wrong referred to the human being are studied by this science. Methodological quality is fundamental in clinical research, and several technical issues are of paramount importance in trying to answer to the final question “what is the true, the right thing?”. Randomised clinical trials: a source of ethical dilemmas

Clinical trials give rise to ethical dilemmas, especially in the acutely ill, but we take issue with two points raised in a recent comment on a specific acute myocardial infarction (AMI) trial. The commentators judged that the trial most likely could, and therefore should, have been terminated much earlier. By analysing the problem statistically we arrive at results that go against their intuitive judgment—they also see it as mandatory to update the patient Information sheet as trial results accrue and trends begin to emerge. The discussion on ethical problems in reproductive medicine that has been going on for quite a decade, is of an exemplary nature; it is mainly focussed on extracorporeal fertilisation, prenatal diagnosis with a view to abortion, and post partum diagnosis and treatment of genetic diseases. The fundamental problems of medical ethics in general come to the fore particularly clearly in this discussion. The following article deals with these fundamental problems, whereas a subsequent article will be concerned in greater detail with the three special disciplines I have just mentioned.
