Se pretende determinar la incidencia de problemas de salud y escolares en menores receptores de Prestaciones Económicas Regladas y de Prestaciones Económicas por Protección. Se valoraron 174 menores de P.E.R. y 123 de P.E.P. Los resultados muestran que una cuarta parte de los menores tienen problemas de salud física y/o mental. Su escolarización plantea problemas de absentismo, aprovechamiento académico, adaptación social y carencias de material escolar. This study determined the effect of health and school problems on minors receiving social aid, such as PER (Economic Aid Program) and PEP (Economic Aid and Care Measures Program). A total of 174 minors and 123 minors receiving PEP and PEP, respectively, were analyzed. The results show that 25% of the minors have physical and/or mental health problems. Their schooling involves problems related to absenteeism, academic performance, social adaptation and a lack of school material. The present article deals with the Italian Electronic Health Record (hereinafter ehr), recently introduced by Act 221/2012, with a specific focus on personal data protection. Privacy issues — e.g., informed consent, data processing, patients’ rights and minors’ will — are discussed within the framework of recent e-Health legislation, national Data Protection Code, the related Data Protection Authority pronouncements and eu law. The paper is aimed at discussing the problems arising from a complex, fragmentary and sometimes uncertain legal framework on e-Health.

Il contributo analizza il quadro normativo comunitario e nazionale in tema di tutela dei minori non accompagnati. In particolare, lo studio si sofferma sui profili del diritto all'ascolto, disciplinato nelle fonti internazionali e nazionali, e sulla partecipazione dei minori, anche attraverso la presentazione di un caso studio. Pur nella consapevolezza dell''intrinseca complessità della questione, si ritiene tuttavia che occorra ancora, sia a livello europeo che nazionale, una maggiore attenzione da parte dei legislatori e una visione di insieme in tema di protezione del minore, che tenga conto della peculiarità della situazione del minore migrante.

Through the latest decision of uncostitutionality regarding article 656 c.p.p., the Constitutional Court strengthened the personalization of the treatment and re-education of convicted minors. The decision states that juvenile delinquency enforcement must leave any rigid automatism and favor the use of alternative resocializing measures, in line with international, conventional and European guidelines.
