La gratuità del divino e la contingenza del mondo fra weak theology e teodicea

As the relationship between God's gratuitousness and the contingecy of the world is concerned, Leibnizian modern theodicy and weak theology seem to radically contradict each other. Nevertheless, both perspectives are able to preserve the simultaneous presence of gratuity and unconditioned givenness of theophany together with the contingency of reality in its heteronomy from the rules of the creationist order, since it is also determined by fortuity. In this way both positions are much more closer than waht they might seem at a first sight.

Partendo dall'arresto giurisprudenziale in tema di impugnazione di testamento olografo per mancanza di autografia, l'Autore analizza la via prescelta dalle Sezioni Unite che sembrerebbero voler superare il contrasto sorto intorno allo strumento processuale più consono fra la querela di falso e la verificazione di scrittura privata, suggerendo la valorizzazione della particolare valenza assunta dalla forma nel testamento olografo. In realtà il richiamo all'actio nullitatis, certamente condivisibile, riapre quel dilemma, costringendo l'interprete a verificare quali siano le conseguenze sul piano processuale della ricostruzione operata sul piano sostanziale.

By Resolutions No. 1483 and 1511 (2003), the Security Council authorized the occupying powers in Iraq to intervene in the political and economic affairs of the occupied territory beyond the limits provided for by international law of war. At the same time, this authorization restricts the right of the Iraqui peole to self- determination, considered in its external aspect. Thus, the problem arises whether it is within the Security Council's powers to adopt resolutions which restrict the enjoyment of rights protected by rules of jus cogens.
