A Marine Spatial Planning Approach to Minimize Discards: Challenges and Opportunities of the Landing Obligation in European Waters

A sensible approach to minimize discards is to avoid areas or seasons where unwanted catch may be present. The implementation of a Marine Spatial Planning (MSP) approach to discard management requires the understanding of marine biological processes, as well as fishing conditions at a defined spatial scale. Mathematical models that analyze the spatio-temporal conditions of selected fishing areas allow the definition of different scenarios where discards are minimized by avoiding fishing for unwanted species and/or illegal specimens. Natural resources management deals with highly complex socioecological systems. Most fisheries management systems rely on a set of regulatory measures to achieve desired objectives. Controls on catch and effort are usually supplemented with gear restrictions, minimum landing sizes, and in the framework of the new common fisheries policy, limitation of discards and by-catch. [EN] The health crisis produced by COVID-19 led to the declaration of the state of alarm by means of Royal Decree 463/2020, of March 14. From that moment, and as a consequence of the measures adopted, among which were: the suspension of the opening to the public of the premises and retail establishments; limiting freedom of movement; and the suspension of administrative terms, the Government proceeded to issue a series of Royal Decree-laws that affected the financial sphere. The object of this study is the analysis of said normative instrument and its constitutional fit when modifying the tax laws within the aforementioned state of alarm.

The European Court of Human Rights (ECtHR) has recently condemned the Spanish State for an infringement of the third article of the European Convention of Human Rights. As a result, the number of condemns to the Spanish State have increased to ten due to violation of the procedural limb of the mentioned article. In other words, because of the non-effective investigation of possible torture cases. The main objective of this paper is to expose the cases and the doctrine that ECtHR has established around this obligation derived from the prohibition of the torture.
