Il commento degli artt. 506 e 507 c.p.p. tiene conto del dibattito in tema di poteri istruttori del giudice e dei più recenti interventi delle sezioni unite della Cassazionew e della Corte costituzionale. L'idea di fondo sottolinea il ruolo suppletivo del giudice come dato nevralgico rispetto all'accertamento, con l'avvertenza, tuttavia, che esso non dovrebbe mai realizzare forme di totale supplenza dell'inerzia delle parti.
Profit vs morality: how unfair is labor market discrimination? Results from a survey experiment

Using an original survey-experimental protocol, we study the normative acceptability of the trade-off between immoral profit (discrimination) and costly morality (non-discrimination). We test the causal influence of three factors: i) the origin of discrimination, ii) the steepness of the morality/profit trade-off and iii) anti-discriminatory moral injunctions. Contrasting with past experimental and attitudinal studies, we find that a significant minority of respondents believe that labor market discrimination is acceptable when morality results in profit loss. We consider the Dirichlet problem-Delta(Kp)(p(x))u(x) - Delta(Kq)(q(x))u(x) = f(x, u(x), del u(x)) in Omega, u vertical bar(partial derivative Omega) = 0,driven by the sum of a p(x)-Laplacian operator and of a q(x)-Laplacian operator, both of them weighted by indefinite (sign-changing) Kirchhoff type terms. We establish the existence of weak solution and strong generalized solution, using topological tools (properties of Galerkin basis and of Nemitsky map). In the particular case of a positive Kirchhoff term, we obtain the existence of weak solution (= strong generalized solution), using the properties of pseudomonotone operators.

Limited resources force individuals to trade-off between life-history traits. A vast diversity of life-history strategies, which optimally combine life history traits, can be found. Knowledge of the genetic basis of this phenotypic variation is key to understanding evolutionary processes. I approached life-history evolution by estimating quantitative genetic parameters for a set of life-history traits in the bank vole (Myodes glareolus).
