The Puzzle of the New European COMI Rules: Rethinking COMI in the Age of Multinational, Digital and Glocal Enterprises
2019
EU Regulation 2015/848 (Recast) laid down new rules on the debtor’s ‘centre of main interests’ (COMI) both to make it easier to determine international jurisdiction and to prevent a debtor from fraudulently relocating his/her/its COMI from one Member State to another. However, the terms of the litigation concerning the NIKI case and an in-depth analysis of the Recast demonstrate that this operation has been unsuccessful. This paper argues: first, that the new COMI rules contain logical and teleological flaws; secondly, that the prerequisite that the COMI ‘shall be the place […] which is ascertainable by third parties’ is a duplicate of the prerequisite ‘on a regular basis’; thirdly, that th…
Global review and synthesis of trends in observed terrestrial near-surface wind speeds: Implications for evaporation
2012
Summary In a globally warming climate, observed rates of atmospheric evaporative demand have declined over recent decades. Several recent studies have shown that declining rates of evaporative demand are primarily governed by trends in the aerodynamic component (primarily being the combination of the effects of wind speed (u) and atmospheric humidity) and secondarily by changes in the radiative component. A number of these studies also show that declining rates of observed near-surface u (termed ‘stilling’) is the primary factor contributing to declining rates of evaporative demand. One objective of this paper was to review and synthesise the literature to assess whether stilling is a globa…
Global collaborative networks on meta-analyses of randomized trials published in high impact factor medical journals: a social network analysis
2014
Abstract Background Research collaboration contributes to the advancement of knowledge by exploiting the results of scientific efforts more efficiently, but the global patterns of collaboration on meta-analysis are unknown. The purpose of this research was to describe and characterize the global collaborative patterns in meta-analyses of randomized trials published in high impact factor medical journals over the past three decades. Methods This was a cross-sectional, social network analysis. We searched PubMed for relevant meta-analyses of randomized trials published up to December 2012. We selected meta-analyses (including at least randomized trials as primary evidence source) published in…
L'ex convento e carcere di San Vito di Agrigento. Studi e proposte per la sua conservazione
2020
“Buoni e cattivi esempi”. Cicerone, Cesare e l’ombra di Silla
2021
The exemplum, one of the tools of persuasion indicated by ancient rhetoric, is used by Cicero in Caesarian Orations with a careful strategy: the exemplary modeling of Caesar allows to define the boundaries of the correct management of res publica. Therefore, in the Pro Marcello Caesar is already presented as a “visible” exemplum, while in the following Pro Ligario the paradigm of Sulla (i.e. that of a dictator guided by crudelitas) becomes effective in admonishing Caesar from a possible degeneration of power.
Application of advanced thermodynamics, thermoeconomics and exergy costing to a Multiple Effect Distillation plant: In-depth analysis of cost formati…
2015
Abstract The high thermal energy consumption per m3 fresh water is one of the main barriers to the spread of thermally driven desalination processes and has limited their use to applications in countries with high reserves of fossil fuels or to specific technological solutions like dual purpose cogeneration plants and solar desalination systems. Being energy conversion efficiency a major issue to improve the performance of thermally driven desalination plants, thermoeconomic analysis has been attracting the efforts of researchers for the identification of margins for process improvement. In this paper a rigorous exergy and thermoeconomic analysis is presented for an 8 effect forward feed Mu…
Advanced energetics of a Multiple-Effects-Evaporation (MEE) desalination plant. Part II: Potential of the cost formation process and prospects for en…
2010
This paper represents the 2nd part of a paper in two parts. In part I a 2nd Principle analysis of a Multiple- Effects-Evaporation (MEE) process has been proposed. In this Part II perspectives for process improvement will be investigated, along two distinct research lines: the thermoeconomics-aided optimization of a new system and the increase of thermal efficiency for existing systems by a pinch-based plant retrofit. As concerns the first research line, a detailed productive structure for the plant stage (i.e. effect) examined in Part I is presented; the cost formation structure is then used to improve a simplified optimization process, revealing capable to properly reflect the interactions…
Why corporates syndicate their investments with a specific partner? An explorative analysis of corporate venture capital co-investments
2016
The 80% of corporates that engage in CVC activities, make these investments with other corporates, recognizing the strategic benefits provided by co-investors. Despite the relevance of this phenomenon, no studies focus on the motivations that drive a corporate to syndicate its investments and most important there are no researches that investigate antecedents that drive a corporate in choosing the partner with whom to syndicate the CVC investments. Thus, the aim of this paper is to study why corporates syndicate their CVC investment with a specific partner. Based on the CVC and the alliance literatures we propose a research framework that considers two main elements characterizing a CVC syn…
