FILOZOFIA PRAWA W ŻYCIU I NAUCZANIU ULPIANA

2017

The Philosophy of Law in Ulpian’s Life and TeachingSummaryThe purpose of this article, is to show, taking into account Ulpian’s life and teaching, that the Roman jurisprudence was interwoven with some elements of philosophy. The first part of the article illustrates the influence of Ulpian’s life history on his philosophical and legislative views, whereas the second part presents the latter. His knowledge of law, the posts which he occupied, and numerous works prove that Ulpian was preoccupied with studying „law through its first causes”. He asked about the essence of the law, about what the natural law is, and what justice is. He described the juridical reality using the language of law and…

Reconciliation without violence

2009

Submitted version of an article published in the journal: Studia Theologica - Nordic Journal of Theology, Taylor & Francis Published version available at Informaworld: http://dx.doi.org/10.1080/00393380903334598 Is it possible to solve conflicts without using violence, or is the use of violent retribution necessary to solve problems and restore peace after serious crimes and offences? This is a classical question in the philosophy of law and in all the disciplines dealing with conflict resolution. It is also an important question in theology. The material for this article comes from interviews with sons who have grown up with violent fathers, and from philosophical and theological texts dea…

The Strange Case of the Protective Perimeter: Liberties and Claims to Non-Interference

2011

In this paper I aim at pointing out some difficulties raised by the so-called thesis of the protective perimeter of liberties (ToPP), that is: the thesis according to which: neither a privilege necessarily involves a claim to non-interference, nor a claim to non-interference necessarily presupposes a privilege. As to the first aspect of the thesis, I argue that it relies on a misleading concept of ‘interference with a liberty’, which surfaces in the examples to which the thesis is made applicable. As to the second aspect of the thesis, I argue that the idea of someone having a claim to be unimpeded in wronging another person is a misleading description of the situation taken into considerat…

Hart’s blind spot. The missing piece in The Concept of Law

2014

A Just Criminalization of Irregular Immigration: Is It Possible?

2015

The aim of this paper is to question, from the perspective of a principled theory of criminalization, the legitimacy of making irregular immigration (IM) a crime. In order to do this, I identify three main ways in which the political decision to introduce a crime of IM may be defended: according to the first, IM is a malum in se the wrongness of which resides in its being a violation of states’ territorial sovereignty; according to the second, IM is a justified malum prohibitum the wrongness of which resides in its being a violation of a justified immigration regulation; according to the third, IM is a malum in se the wrongness of which resides in its harmful consequences for receiving stat…

Human Rights and Substantive Equality in the Adjudication of Ethnic Practices

2016

With the development of human rights and anti-discrimination law, courts have increasingly been called upon to protect ethnicity related practices from general criminal and civil sanctions. These ‘claims of culture’ have so far been addressed with remarkable inconsistency, leading to popular fears of unlimited normative pluralism and targeted legislative measures. Compounding such controversies, philosophical approaches to multiculturalism have mostly been concerned with policy and offered vague or distorted portrayals of judicial challenges. This article seeks to fill the gap by exploring how the legal standard of substantive equality might structure the courts’ approach to a range of case…

Gustav Radbruch, a left-wing jurist under the Weimar Republic

2011

What did it mean to be a left-wing jurist under the Weimar Republic? This study attempts to answer this question through the example of Gustav Radbruch (1878-1949), legal philosopher, but also Social-Democratic activist, supporter of the Republic and for some time Member of Parliament and Justice Minister. Even though he is not as well-known as Hans Kelsen or Carl Schmitt,, Radbruch participated in all the important legal debates of his time – debates which reflected the most significant issues of that time of crisis, the Weimar Republic. By analyzing the way in which Radbruch responded to the challenges of the crisis of law and democracy, this study tries to contribute to a better comprehe…

The present work aims to analyze the link…

Desobediencia: ¿Derecho o estrategia?

ABSTRACT: We are possibly facing a turning point in the tradition of the right of resistance and even civil disobedience. From the globalization of the phenomenon of the indignados, the recourse to the strategy of disobedie…
