Ambiente e diritto penale: brevi riflessioni fra le modifiche agli artt.9 e 41 Cost. e le prospettive di riforma in ambito internazionale

l contributo analizza l’impatto che il recente inserimento dell’ambiente in Costituzione può dispiegare in ambito penale, tanto rispetto all’ambiente quale oggetto della tutela penale, quanto sul versante della selezione dei modelli di illecito, soffermandosi in particolare sul problema delle possibili ricadute penalistiche del nuovo vincolo di solidarietà ecologica di tipo intergenerazionale. Seguendo il fil rouge del bene giuridico, la seconda parte del saggio ricostruisce invece i punti critici e le prospettive di sviluppo del diritto penale ambientale internazionale, alla luce della nozione di ambiente quale bene giuridico comune ed universale.

The paper analyses the impact that the recent inclusion of the environment in the Italian Constitution may have in the criminal law both with respect to the criminally relevant notion of the environment and with regard to the selection of the types of criminal offences. From this point of view the paper also takes into consideration the penal significance of the new bond of intergenerational ecological solidarity. Following the file rouge of the “bene giuridico” the second part of the essay is instead dedicated to the description of the critical points and the possible developments of international environmental criminal law in the light of a conception of the environment as a common and universal legal good.Settore IUS/17 - Diritto Penale

Homeostasis in the Central Dogma of molecular biology: the importance of mRNA instability

Cell survival requires the control of biomolecule concentration, i.e. biomolecules should approach homeostasis. With information-carrying macromolecules, the particular concentration variation ranges depend on each type: DNA is not buffered, but mRNA and protein concentrations are homeostatically controlled, which leads to the ribostasis and proteostasis concepts. In recent years, we have studied the particular features of mRNA ribostasis and proteostasis in the model organism S. cerevisiae. The present article attempts to record and present as much as possible the Latin translations of hagiographical texts during the Middle Byzantine period. The Patres ecclesiae?s works were a frequent topic of discussion at the time in which many humanists stood against the decadent medieval scholastics. That Juan Luis Vives was part of this tradition is demonstrated in his commentaries on Saint Augustine works. Despite its pedagogical function, the scholia of the Valencian author became quite subjective. In this sense, his ecdotic work or, specially, his «criticisms and censures» can be mentioned. Here, Vives strongly disapproves of the intense political and intellectual turmoil of his epoch. Abstract Intermittent hypobaric hypoxia (IHH) has been the focus of important research in cardioprotection, and it has been associated with several mechanisms. Intermittent hypobaric hypoxia inhibits prolyl hydroxylases (PHD) activity, increasing the stabilization of hypoxia-inducible factor-1 (HIF-1) and activating crucial adaptative genes. It has been hence suggested that IHH might be a simple intervention, which may offer a thoughtful benefits to patients with acute myocardial infarction and no complications. In his latest book Massimo La Torre makes a number of criticisms to legal positivism. Most of them are convincing. In this essay I try to reply to the few I disagree with. In particular, I deal with La Torre’s objections against Hart’s theories on legal interpretation and the internal point of view and against Raz’s theory of legitimate authority. In the last paragraph I outline some ideological reasons for not considering legal positivism entirely dead.

The dehumanization of whiteness in Maxine Hong Kingston’s The Woman Warrior (1976) inheres in the overarching ghosthood metaphor. While first generation Chinese American immigrants in The Woman Warrior attribute the power of transforming people into ghosts to the United States of America as a country, the questioning of a person’s humanity by calling them a “ghost” is not reserved for white people alone. Chinese American immigrants also run the risk of losing their humanity and becoming ghosts if they renounce their relatives and their heritage.
