Przekształcenia struktur wieku ludności gmin województwa opolskiego wyznacznikiem dla lokalnych polityk społecznych

2018

The Current European Normative Frame

2016

The rapid introduction of the normative frame on the European scale, both communally and nationally, follows the historical investigation presented in the first chapter of this dissertation, with a double purpose: to define the issues of the current debate on the one hand and to describe the state of the art on the other. Directive 2001/42/EC of the European Parliament and Council of 27 June 2001 concerning the assessment of effects of certain plans and programmes on the setting was officialised in July of that year, generating a wide range of experiences. It establishes a basic framework that should be adopted by the member states of the European Union. In the previous chapter, we showed t…

Let Me in! The Affirmation of a Radical “Other”

2021

In the preceding chapters, we carefully revised the history of colonial expeditions, the intersection of the native “Other” with science, and the evolution of leisure travels and the consolidation of the tourism industry. We make the point that after the terrorist attacks in 2001 in the US, Western civilization entered a state of crisis which gradually tended to demonize the non-Western “Other”. These chapters acted as conceptual platforms that guided readers to understand the role played by hospitality in the configuration of the modern nation-state. Although illustrative to some extent, these chapters lacked an empirical approach. This chapter, complementarily, keeps an empirically based …

Civil and Commercial Mediation and National Courts: Towards a New Concept of Justice for the XXI Century?

2017

Modern societies are very much linked to the idea of litigation. The incessant increase in the level of litigation puts the whole judicial system under pressure because the volume of disputes brought before State courts increases, the proceedings are getting more and more lengthy and the costs incurred by the parties in such proceedings are also greatly increasing. This situation can impair the full implementation of the principle of access to justice for citizens.

The Role of Force

1995

Max Weber defined the state as an organization which successfully maintained the monopoly of legitimate violence over certain territory. This definition, simple as it is, raises several problems. Firstly, it should be noted that it is at best the definition of the modern State. There have been organizations which are, perhaps anachronistically, called states by historians or anthropologists, but which did not satisfy the definition.

The Foundations of Legal Systems

1995

The most important institution claiming political authority in modern societies is the State and its legal system. Both in legal and in political theory the questions which are traditionally held to be the most fundamental are centered around this claim.

The Emergence and Restoration of the State: Latvia in 1918 and 1990

2021

Abstract On 18 November 1918, the independent Republic of Latvia was declared in an extremely complicated international and domestic environment—the First World War was still going on, empires were collapsing, and ethnically and ideologically diverse military troops were fighting within the boundaries of Latvian territory. Despite the historical context of a previously tense relationship between Latvians and other ethnic groups, representatives of all minorities fought next to Latvians against the enemies of the Latvian state. Up until 11 August 1920, when the Peace Treaty with the Soviet Russia was signed, the prospects of de jure recognition of the newly established state were blurred; ye…
