This study explores mothers’ experiences of their children’s custody. The empirical data consists of twelve interviews with mothers with a child custody experience. Seven interviews were conducted twice, in years 2004 and 2008. The purpose of the dissertation is three-fold: 1) to clarify the construction of motherhood before and after the custody; 2) to define what kind of support the mothers received after the children had been placed outside home; and 3) to identify promotive and hindering factors for the empowerment of these mothers. The article discusses the issue of changes of the bases of legitimization for the state judiciary in the US during the so-called “Jacksonian Democracy”, i.e., the period from 1829 (the beginning of the presidency of Andrew Jackson) until the outbreak of the Civil War. During this period on the wave of the democratization process of public institutions in the US, popular elections were introduced to select judges at the state level. The well-known Sonnet XIII by Garcilaso de la Vega «A Dafne ya los brazos le crecían» was to establish the disconsolate figure of Apollo, pining for the loss of Daphne, as the literary paradigm of the pangs of love —at least in Renaissance literature in the Iberian peninsula. Thus, a century later, Francesc Fontanella revisited the Garcilaso sonnet and carried out a profoundly Baroque re-reading.
