Disobbedienza civile o lotta per il diritto? Un bilancio di cinque anni di criminalizzazione del soccorso in mare
2022
this contribution traces the main stages of the process of criminalization of non-governmental organizations' search and rescue activities in the Central Mediterranea Sea, to light the paradoxes and the shadows. The theoretical framework is that of the civil disobedience and its counterpart, the obligation to obey the law. This perspective, emblematic for investigating complexity, limits and potential of the law itself, has been used because it can bring out the specificity of the positions assumed by the main players involved in the events, as well as the legal and socio-cultural consequences of their actions, by interrogating the dimensions of legality and justice.
Principles, balancing, and the separation between law and morals: on neo-constitutionalism and its critics
2011
2017
In this article I will analyse seven types of harms, which can be relevant or irrelevant for the justification of the use of criminal coercion. This conceptual operation is important to solve a fundamental problem, relative to the validity of the Offence Principle according to the liberal ethics
Obergefell e il futuro del matrimonio
2016
in this article i will analyze the arguments adduced in the famous judgement of the supreme court of united states Obergefell v. Hodges.
Non c’è diritto senza fiducia. In difesa di una concezione fiduciaria dl diritto
2022
The author critically discusses some main points of Tommaso Greco’s book La legge della fiducia. Greco distinguishes two models of law – the fiduciary model and the anti-fiduciary one – and supports the first model with good arguments. This review, while endorsing Greco’s conclusions, emphasizes some reason for perplexity and claims that the anti-fiduciary model of law helps to maintain a critical attitude towards the law.
El coste de una decisión que se no quiere tomar. Observaciones acerca de la introducción del delito de tortura en el ordenamiento italiano y un esboz…
2020
After a difficult and disputed drafting, on July 5, 2017, the Italian Parliament approved the Act n. 110/2017, which introduced the crime of torture in Italy. The lack of will of Italian Parliament in promulgating the law, even though Strasbourg Court urged in several occasion to reform the law in order to avoid cases of insufficient sanctions in case of violation of art. 3 of the European Convention on Human Rights, can be explained through a redefinition of the model of legislative rationality: legislator might be considered rational when it enacts ambiguous legislative texts at the lowest electoral cost if it urged to do by the pressure of supranational jurisdictions. Finally, even thoug…
Multiple solutions with sign information for a (p,2)-equation with combined nonlinearities
2020
We consider a parametric nonlinear Dirichlet problem driven by the sum of a p-Laplacian and of a Laplacian (a (p,2)-equation) and with a reaction which has the competing effects of two distinct nonlinearities. A parametric term which is (p−1)-superlinear (convex term) and a perturbation which is (p−1)-sublinear (concave term). First we show that for all small values of the parameter the problem has at least five nontrivial smooth solutions, all with sign information. Then by strengthening the regularity of the two nonlinearities we produce two more nodal solutions, for a total of seven nontrivial smooth solutions all with sign informations. Our proofs use critical point theory, critical gro…
Positive and nodal solutions for nonlinear nonhomogeneous parametric neumann problems
2020
We consider a parametric Neumann problem driven by a nonlinear nonhomogeneous differential operator plus an indefinite potential term. The reaction term is superlinear but does not satisfy the Ambrosetti-Rabinowitz condition. First we prove a bifurcation-type result describing in a precise way the dependence of the set of positive solutions on the parameter λ > 0. We also show the existence of a smallest positive solution. Similar results hold for the negative solutions and in this case we have a biggest negative solution. Finally using the extremal constant sign solutions we produce a smooth nodal solution.
Iterated Conditionals, Trivalent Logics, and Conditional Random Quantities
2022
We consider some notions of iterated conditionals by checking the validity of some desirable basic logical and probabilistic properties, which are valid for simple conditionals. We consider de Finetti’s notion of conditional as a three-valued object and as a conditional random quantity in the betting framework. We recall the notions of conjunction and disjunction among conditionals in selected trivalent logics. Then, we analyze the two notions of iterated conditional introduced by Calabrese and de Finetti, respectively. We show that the compound probability theorem and other basic properties are not preserved by these objects, by also computing some probability propagation rules. Then, for …
