The Reception of Positivism in Spain: Pedro Dorado Montero

The current thesis focuses in one of Spain’s most relevant authors: Pedro Dorado Montero. Acting as a bridge between the criminal law conceptions of the 19th and 20th centuries, Dorado Montero offered a very unique, original theory: the ‘Derecho protector de los criminales’ (Protective Law of the Criminals). Towards the end of the 19th century, a clash between the penal neoclassical theories and the new positivist theories took place. As a result, the hegemony of the old school was contested. To this respect, Dorado Montero’s scholarly career, the context in which he lived and the several European and other international influences he received are duly analysed. Germanic laws focused mainly on community and kinship ties, they clearly defined social divisions and organized the life of the community. The law was not to be perceived as a product of the times, it was passed on from generation to generation and conveyed the wisdom of the elder. Every crime against another person or their property, independently of whether it concerned family laws, laws of property or any other laws, had to be compensated in accordance with customary rules as well as the social status of the aggrieved. Depression and Sequential Decision-Making Revisited

Background: The effect of depression on decision-making is an important but still an unsettled issue. Although most studies have reported that clinically depressed participants show worse performance, there are also studies that have shown no or even positive effects. Specifically, von Helversen et al. (2011) were able to document a positive effect of depression on task performance in a sequential decision-making task called the secretary problem (SP). Here, we (1) aimed to replicate this study in an extended version using more trials and (2) modified it by including an additional condition in which negative feedback was given. Partendo dalla constatazione che la violenza di genere investe non solo il piano delle azioni, ma anche quello simbolico delle rappresentazioni e coesiste con i frame della libertà e della reciprocità, il saggio si propone di analizzare le forme di percezione, valutazione e rilevanza assegnate alla violenza, in contesti di normalità. Vengono evidenziate le situazioni in cui la violenza si manifesta ritualizzandosi, riiscritti gli elementi che la connotano, riletta la rappresentazione che ne viene fatta dai mass media.
