In recent years, the influence of European and international laws has led to an ever-increasing pressure against the immunization and protection from liability that the judiciary has so far enjoyed. This work investigates the issue of the liability of the food producer in the light of the European legislation that has always sought a balance between consumer protection and market protection. From the analysis made it is clear that the efforts carried out in the first direction and pursued also with the legislation on food safety, however, fail to make the protection of the consumer really full and effective. The author then proposes regulatory changes aimed at increasing consumer protection by not hindering the principle of free movement of goods.
