Operators in Rigged Hilbert Spaces, Gel’fand Bases and Generalized Eigenvalues
2022
Given a self-adjoint operator A in a Hilbert space H, we analyze its spectral behavior when it is expressed in terms of generalized eigenvectors. Using the formalism of Gel’fand distribution bases, we explore the conditions for the generalized eigenspaces to be one-dimensional, i.e., for A to have a simple spectrum.
Lesiones de hemisferio derecho. Materiales y análisis pragmático (Volumen VII del corpus PerLA).
2011
Impact of operation duration on postoperative outcomes of minimally-invasive right colectomy
2022
Aim: Operation time (OT) is a key operational factor influencing surgical outcomes. The present study aimed to analyse whether OT impacts on short-term outcomes of minimally-invasive right colectomies by assessing the role of surgical approach (robotic [RRC] or laparoscopic right colectomy [LRC]), and type of ileocolic anastomosis (i.e., intracorporal [IA] or extra-corporal anastomosis [EA]). Methods: This was a retrospective analysis of the Minimally-invasivE surgery for oncological Right ColectomY (MERCY) Study Group database, which included adult patients with nonmetastatic right colon adenocarcinoma operated on by oncological RRC or LRC between January 2014 and December 2020. Univariate…

Evolution of the suicides’ right to funeral and burial in Canon Law and Polish Law
2020
For centuries, funeral law was not too favourable to suicides. Admittedly, at the dawn of Christianity this group of the deceased was not refused religious funeral celebrations or a burial, yet, the situation changed along with the Catholic religion gaining significance. At the beginning of the Middle Ages, suicides were deprived of the right to a religious funeral. Furthermore, in the 11th century the ecclesiastical legislator forbade burial for suicides in “holy places.” Until modern times, therefore, suicides were buried at a distance from grave- yards. This in practice often indicated a burial insulting human dignity. The monopoly on religious funeral regulations only ended in Europe at…

LAW AND SOCIAL CHANGE: RIGHT TO A NAME, PERSONAL IDENTITY AND PRIVATE LIFE IN CONTEXT
2014
The name is the key to identify a single individual and to link a person to her family, as well as the primary interface in the relationship between a person and the community he or she lives in. This study claims that private life and private autonomy are becoming interpretative arguments and vehicles to ensure that law would be able to follow – and sometimes to chase – social changes in personal and family life, in finding new rules to regulate the relationship between the individual, the family and public authorities or between a private individual and the community she interfaces with.1 Judicial interpretative activity often reveals legislative shortcomings. In particular, the judiciary…
Il principio dell’insindacabilità della valutazione del merito creditizio alla prova dei miniprestiti emergenziali integralmente coperti da garanzia …
2022
Article 13, lett. m), of law decree n. 23/2020 introduced some measures in order to expand firm’s access to credit and counter the negative effects of COVID-19 pandemic. After providing an historical view of the italian legislation in the field of pubblic credit, the two authors argue that the aforementioned article, which in their view introduce a right to credit, is not an isolated case, given that the legislator had already introduced limits to the private autonomy of banks in presence of public subsidies. Moreover, according to the authors the duty to make credit and the limits and restrictive conditions for access to credit provided for by law exclude civil or criminal liability for un…
Occasioni mancate: il bilanciamento tra diritto alla vita familiare e best interest of the child, e la rappresentanza del minore nella sentenza Stran…
2020
The recent judgment of the Grand Chamber of the European Court of Human Rights in Strand Lobben and others v. Norway raises, among others, two interesting reflections. First, it expressly requires a balance between the best interest of the child and other rights, such as the parents’ interest to the maintenance of family relationships. However, the conclusion reached by the Court – finding a violation of art. 8 of the Convention only in respect of its procedural aspect – does not match with the premises. Second, the (missed opportunity for) balancing is carried out without guaranteeing the proper representation of the minor in the judgment. This procedural gap in the Court’s regulations sho…
Casual, Colloquial, Commonsensical: A News Values Stylistic Analysis of a Populist Newsfeed
2021
This study explores a mediated variety of right-wing populist discourse in the digital context, given the populists’ inclination to bypass legacy media to connect directly to the citizens to garner political support. It analyzes a sample of the Tea Party’s newsfeed headlines posted in the spring of 2019. A corpus of 308 headlines collected according to a “constructed week” formula has been coded first according to selected news values parameters (Bednarek and Caple 2017), and then with respect to stylistic devices operationalized in terms of “casual,” “colloquial” and “commonsensical” expressions. Methodologically, the study aims to combine the perspectives of newsworthiness and stylistics …
