Discriminazione indiretta e orario di lavoro

Costituisce discriminazione indiretta ai sensi dell’art. 2 D.Lgs. 9 luglio 2003, n. 216, in danno delle lavoratrici madri (soggetti che cumulano il fattore di rischio costituito dal sesso femminile con il fattore di rischio costituito dalla maternità), una nuova organizzazione dell’orario di lavoro, la quale renda estremamente difficoltosa – se non impossibile – la conciliazione dei tempi di vita e di lavoro e la fruizione degli istituti giuridici a ciò preposti: la discriminazione indiretta, infatti, alberga non nel trattamento – che è uguale per tutti i dipendenti – ma negli effetti, che sono diversi perchè diverse sono le situazioni soggettive dei destinatari del trattamento.

Abstract Discriminant analysis applied to SAR studies using topological descriptors allows us to plot frequency distribution diagrams: a function of the number of drugs within an interval of values of discriminant function vs. these values.
