Normative Legal Positivism, Neutrality, and the Rule of Law

Usually, in jurisprudential debates what is discussed under the rubric of ‘neutrality’ is the claim that jurisprudence is (or at least can, and should be) a conceptual, or descriptive - thus, non-normative, or morally neutral - inquiry. I discuss neutrality in an altogether different sense, namely, neutrality as an ethico-political ideal the law should meet. My starting point is normative legal positivism, or the claim that it is a good and desirable thing that the laws have easily identifiable, readily accessible, as far as possible non-controversial social sources. After analyzing some Italian recent trends on the ethics of legal professions, and comparing this debate with the discussion abroad, it is introduced the difference between deontology and ethics of legal professions, and pros and cons of the approach of virtue ethics are pondered. In the final part, the legal virtues are linked to the virtue of law, the rule of law, in order to show that the success of law as a practice depends also on virtues of legal practitioners.

The article presents the issue of trust in law as one of the fundamental values of a rule-of-law state. The analysis of the court rulings conducted in the first part of the article indicates the principle of a democratic rule-of-law state as a basis for distinguishing substantive and formal components of trust in law. Further considerations of the article focus on showing the change of law, in particular its transition from repressive law to responsive law, and the possible effects of this change on the paradigm of trust established in a democratic ruleof-law state. La teoria del diritto come pratica sociale e la coercizione

Poiche non si puo trattare del posto che la coercizione ha nel concetto di diritto senza far riferimento ad una specifica teoria del diritto, il paper ricostruisce le linee generali della teoria del diritto come pratica sociale, focalizzando in particolare l’obiettivo del diritto di custodire l’agency dei consociati per contrastare l’uso arbitrario del potere. Nella seconda parte si affronta dal punto di vista del diritto come pratica sociale il tema generale della coercizione giuridica e ci si chiede soprattutto se l’uso giuridico della forza non sia anch’esso nella sostanza una forma di potere che contraddice il fine generale della custodia dell’agency.
