Aristotle’s Doctrine of Causes and the Manipulative Theory of Causality
2018
I will argue for the similarity between some aspects of Aristotle’s doctrine of causes and a particular kind of interventionist theory of causality. The interventionist account hypothesizes that there is a connection between causation and human intervention: the idea of a causal relation between two events is generated by the reflection of human beings on their own operating. This view is remindful of the Aristotelian concept of αἴτιον (cause), which is linked to the figure of the αἴτιος, the person who is responsible of an action. Aristotle conceives of the efficient cause as the active element which, in the φύσις, gives rise to movement and imposes the form, in analogy with the active ele…
IS MONTAIGNE A SKEPTIC? PASCAL'S INFLUENCE ON OUR UNDERSTANDING OF THE ESSAYS
2019
ABSTRACT Michel de Montaigne, the renowned author of The Essays, has been interpreted as a skeptic, and, more specifically, as a defender of skeptical fideism. This reading has its main…
The German Fascists: Nazi Political Culture
2019
The rise to power of National Socialism in early 1933 made Germany become the second fascist regime and seemingly confirm fascism’s universal character. In this text, Morant examines Nazism as the German exponent of the fascist political culture by focusing both on the most characteristic elements of its world view (anti-Semitism, the myth of the Volksgemeinschaft, its nature as a political religion and its totalitarian ambitions) and the visible representations of a movement that paid special attention to future generations and did not neglect (non-Jew) women, since they constituted at least half of the “national community”. Many of these elements distinguish Nazism from its reactionary na…
Les victimes de viol devant les tribunaux à la fin du Moyen Âge d'après les sources dijonnaises et lyonnaises
2005
At the end of the Middle Ages, the manner in which the courts of justice punished rapists clearly shows how seriously such crimes were judged at that time. Endeavoring to increase their juristic power and worrying that the propagation of rape would corrupt the entire society and threaten its survival, impelled the judges and their officials —princes, bishops, and municipal bodies — to deal with all complaints and to initiate inquiries about them. A study of the progressive steps undertaken in the preliminary investigations of these cases reveals that after an inquiry into the accuser's reputation, the judges demanded numerous proofs from the victim about the rape. Moreover, a clinical exami…
Determination of Death in Execution by Lethal Injection in China.
2018
Abstract:Since 1997, execution in China has been increasingly performed by lethal injection. The current criteria for determination of death for execution by lethal injection (cessation of heartbeat, cessation of respiration, and dilated pupils) neither conform to current medical science nor to any standard of medical ethics. In practice, death is pronounced in China within tens of seconds after starting the lethal injection. At this stage, however, neither the common criteria for cardiopulmonary death (irreversible cessation of heartbeat and breathing) nor that of brain death (irreversible cessation of brain functions) have been met. To declare a still-living person dead is incompatible wi…
Re-Thinking the Use of Conscientious Objection by Health Professionals: A Regulatory Proposal Based on Legal Abortion Practices in Argentina
2019
“Ninety percent of health-care practitioners will not perform abortions,” warned physicians in Chaco, a province in north-eastern Argentina, during the debate in Argentina’s Senate to extend the legalization of abortion in July 2018. Around this same time, in a nearby province, Misiones, every physician in one hospital declared that they would register as conscientious objectors should the legislation prove successful. Just a few days earlier, Argentina’s press reported that more than 200 girls had been raped and forced to give birth in Misiones, without access to legal abortion under the rape indication. In Argentina abortion is legally permitted in cases where a pregnancy presents a risk …
Ethics Literacy and "Ethics University": Two Intertwined Models for Public Involvement and Empowerment in Bioethics.
2016
Background Informing lay citizens about complex health-related issues and their related ethical, legal, and social aspects (ELSA) is one important component of democratic health care/research governance. Public information activities may be especially valuable when they are used in multi-staged processes that also include elements of information and deliberation. Objectives This paper presents a new model for a public involvement activity on ELSA (Ethics University) and evaluation data for a pilot event. Methods The Ethics University is structurally based on the “patient university,” an already established institution in some German medical schools, and the newly developed concept of “ethic…
