La giuridicità del diritto di resistenza nello Stato costituzional-democratico: una proposta teorica

Il presente lavoro intende indagare i profili di giuridicità del diritto di resistenza come un “diritto giuridico” e una pratica costituzionale giustificabile sul terreno normativo. L’ambito della ricerca è circoscritto agli ordinamenti costituzional-democratici. L’obiettivo finale è mostrare che alcuni casi di “resistenza” dovrebbero essere protetti dalla costituzione ed esentati parzialmente o totalmente dalla punizione prevista per la trasgressione della norma giuridica resistita. Immanuel Kant’s project for a critique of reason exhibits a foundation that has an avowedly not despotic profile. This article presents some considerations about Paolo Pastori's book "Alla ricerca di un ordine nuovo". It analyses the period between 1759-1821 and it exceeds some schematisms on historiographic reconstructions proposing new interpretations. This article, in particular, pays attention to the constitutions during 1791-1812 and shows the American constitutional mortage, as well as the reciprocal influences on French and Italian constitutions elaborated from the outbreak of The French Revolution to the Restoration period.

Francis Osborne (1593-1659) was the celebrated author of The Advice to a Son, a very popular book in his days. He also wrote some tracts and pamphlets during the so called “Engagement Controversy”, that led to the publication of many republican writings to support the new regime. Osborn’s intellectual and ideological contribution was peculiar, because his condemn of tyranny was carried on in a political language that used Machiavellian ideas, the republican concept of liberty and the new and well-known expression “reason of state”.

Co-evolution of three mega-trends nurtures un-captured GDP – Uber's ride-sharing revolution

Uber used a disruptive business model driven by digital technology to trigger a ride-sharing revolution. The institutional sources of the company’s platform ecosystem architecture were analyzed to explain this revolutionary change. Both an empirical analysis of a co-existing development trajectory with taxis and institutional enablers that helped to create Uber’s platform ecosystem were analyzed. The analysis identified a correspondence with the “two-faced” nature of ICT that nurtures un-captured GDP. This two-faced nature of ICT can be attributed to a virtuous cycle of decline in prices and an increase in the number of trips. We show that this cycle can be attributed to a self-propagating …
