The international crime of sexual slavery and the practice of «forced marriages»
2015
The crime of sexual slavery is the international crime of sexual nature that, both as a crime against humanity and as a war crime, most difficulties is causing for its determination by international tribunals. This paper is devoted to the study of the international jurisprudence established by the International Tribunal for the former Yugoslavia, the Special Court for Sierra Leone and the International Criminal Court on the crime of sexual slavery and, in particular, on the practice of the so-called «forced marriages».
Chemistry, microscopy and smell: bloodstains and nineteenth-century legal medicine
2015
This paper analyses the development of three methods for detecting bloodstains during the first half of the nineteenth-century in France. After dealing with the main problems in detecting bloodstains, the paper describes the chemical tests introduced in the mid-1820s. Then the first uses of the microscope in the detection of bloodstains around 1827 are discussed. The most controversial method is then examined, the smell test introduced by Jean-Pierre Barruel in 1829, and the debates which took place in French academies and learned societies during ensuing years are surveyed. Moving to the courtrooms a review is conducted of how the different methods were employed in criminal trials. By revi…
El litigio climático ante la responsabilidad intergeneracional
2021
The protection of minority shareholders during delisting in Germany and in the U.K.
2020
The thesis seeks to compare the protection of minority shareholders during delisting in Germany and in the UK. Delisting refers to a publicly traded company leaving the stock market. In order to compare the protection afforded by the relevant legislator the thesis first seeks to give an overview of the interests touched upon by delisting, finding the main risk for minority shareholders is unlike often assumed not a loss of value but the loss of the share’s tradability. The thesis then compares the approach taken towards the problem and the instruments utilized by both legislators. Here the thesis finds that the German law represents a stricter and inflexible solution, while the British law …
Electromagnetic properties of low-lying states in neutron-deficient Hg isotopes: Coulomb excitation of Hg-182, Hg-184, Hg-186 and Hg-188
2019
The neutron-deficient mercury isotopes serve as a classical example of shape coexistence, whereby at low energy near-degenerate nuclear states characterized by different shapes appear. The electromagnetic structure of even-mass 182-188 Hg isotopes was studied using safe-energy Coulomb excitation of neutron-deficient mercury beams delivered by the REX-ISOLDE facility at CERN. The population of $ 0^{+}_{1,2}$01,2+, $ 2^{+}_{1,2}$21,2+and $ 4^{+}_{1}$41+states was observed in all nuclei under study. Reduced E2 matrix elements coupling populated yrast and non-yrast states were extracted, including their relative signs. These are a sensitive probe of shape coexistence and may be used to validate…
Customer due diligence requirements, in the context of anti-money laundering regulations in Latvia.
2021
This thesis investigates the problem of Latvian banks’ discriminatory habits towards non-residents in the context of anti-money laundering (AML) regulations, a practice which could have a negative impact on direct foreign investments in Latvia. The main objective of this study is to determine if the problem derives from legal norms or from banks’ arbitrary decisions. The research method is doctrinal legal research. The main conclusions are that Latvian AML legislation is partially aligned with FATF recommendations, therefore future restrictions should be expected. Analysis of the know your customer and due diligence requirements showed an absence of discrimination against non-residents. Cer…

Chloroplast DNA and isozyme analysis of the progenitor-derivative species relationship between Senecio nebrodensis and S. viscosus (Asteraceae )
1995
A comparison of chloroplast DNA (cpDNA) and isozyme diversity in Senecio nebrodensis L., a species restricted to certain mountain ranges in Spain, and S. viscosus L., a widespread ruderal species in Europe, revealed that S. viscosus possessed the more common of two cpDNA haplotypes resolved in S. nebrodensis and contained only a small subset of the alleles found in S. nebrodensis at enzyme coding loci. The two species shared one restriction length mutation and one site mutation in their cpDNA, which distinguished them from other European Senecio species examined previously. Taken overall, these results support the hypothesis that S. nebrodensis and S. viscosus are related as a progenitor-de…
Derecho, narración y racionalidad jurídica. El caso de la fazaña bajomedieval
2011
El formalismo interpretativo y el iusnaturalismo actual: la posición de John Finnis | The Interpretive Formalism and the Current Iusnaturalism: The P…
2014
Abstract: Today, we can see a revival of formalist tendencies in the interpre…
