The dynamics of private property: between individual rights and common interests

2021

The present research explores the tension implicit in the right to property as an exclusionary right. The conceptualization of the right to property as a necessary component of individual freedom stands at odds with a universal exercise of the right in the context of scarcity. Both moral and economic considerations align in the necessity for property, but these justifications are of a principally divergent order. The natural law perspective is predominantly anchored in the atomic – the interest of the individual in personal freedom and well-being. The focal point of the economics approach is in the aggregate – the benefit to be reaped in the rights’ systematic application. The present work …

Measurements of the T2K neutrino beam properties using the INGRID on-axis near detector

2012

Precise measurement of neutrino beam direction and intensity was achieved based on a new concept with modularized neutrino detectors. INGRID (Interactive Neutrino GRID) is an on-axis near detector for the T2K long baseline neutrino oscillation experiment. INGRID consists of 16 identical modules arranged in horizontal and vertical arrays around the beam center. The module has a sandwich structure of iron target plates and scintillator trackers. INGRID directly monitors the muon neutrino beam profile center and intensity using the number of observed neutrino events in each module. The neutrino beam direction is measured with accuracy better than 0.4 mrad from the measured profile center. The …

Charge radii of neon isotopes across the sd neutron shell

2011

We report on the changes in mean square charge radii of unstable neon nuclei relative to the stable Ne-20, based on the measurement of optical isotope shifts. The studies were carried out using collinear laser spectroscopy on a fast beam of neutral neon atoms. High sensitivity on short-lived isotopes was achieved thanks to nonoptical detection based on optical pumping and state-selective collisional ionization, which was complemented by an accurate determination of the beam kinetic energy. The new results provide information on the structural changes in the sequence of neon isotopes all across the neutron sd shell, ranging from the proton drip line nucleus and halo candidate Ne-17 up to the…

Flaws in the Treaty on the Non-Proliferation of Nuclear Weapons as shown by Marshall Islands v. United Kingdom, Marshall Islands v. Pakistan, Marshal…

2020

The Treaty on the Non-Proliferation of Nuclear Weapons (NPT) amongst its goals included both non-proliferation of nuclear weapons and nuclear disarmament. The cases Marshall Islands v. United Kingdom, Marshall Islands v. Pakistan, Marshall Islands v. India show that nuclear disarmament remains an unresolved issue. These cases refer to Article VI of NPT as being breached, and allege that the NPT can be considered to be customary international law. Furthermore, nuclear non-proliferation obligation has been fulfilled, however the obligation of nuclear disarmament has not been fulfilled. The Marshall Islands cases present three significant flaws in the NPT. The first flaw which is the ambiguous…

An analysis of the nutrition and allergen labelling rules in the EU and their implications on the common market

2018

The EU Regulation 1169/2011 also known as food information to consumers’ regulation introduced two advancements - a mandatory nutrition declaration for prepacked food as well as mandatory allergen labelling for prepacked foods plus minimum requirements for allergen representation for non-prepacked foods. The article analysis the interaction between the relevant EU laws and Member State regulations. For this study there were four Member States chosen – Latvia, France, the Netherlands and the UK. Article then looks at the legal evaluation and observes the implications to common market. As the possible consequences are named restriction on free movement of goods and market fragmentation. In ad…
