CRIME AND PUNISHMENT: ADAM SMITH’S THEORY OF SENTIMENTAL LAW AND ECONOMICS

2020

For Adam Smith, a crime is not the result of a rational calculation of loss and gain but the consequence of envy and a vain desire to parade wealth to attract the approbation of others, combined with a natural systematic bias in overestimating the probability of success. Similarly, Smith does not conceive of legal sanctions as a rational deterrent but as deriving from the feeling of resentment. While the prevailing approach of the eighteenth century is a rational explanation of crime and a utilitarian use of punishment, Adam Smith instead builds his theory of criminal behavior and legal prosecution consistently on the sentiments. A well-functioning legal system is thus an unintended consequ…

Suspected cutaneous leishmaniasis in a sample of Western Sicily residents: what correlation with occupation?

2017

Background: Leishmaniasis is a widespread infectious disease, but there is not much information about its prevalence in high risk occupational categories. Objectives: Te aim of this study is to assess the prevalence of Leishmania immunological positivity in human skin tissues collected from subjects living in Western Sicily, with suspected cutaneous Leishmania infection, in order to explore the risk possibly related to occupation. Methods: 318 consecutive subjects (M/F ratio=1.0, mean age=40±25.4 years), attending the Dermatology Department of the University of Palermo Hospital from 2013 to 2015, without any previous history of Leishmania infection and performing various occupations, were i…

Phenotypic traits and establishment speed of 44 turf bermudagrass accessions

2014

Breeding of turf bermudagrass (Cynodon (L.) Rich.) has made available a broad range of turf varieties with unique morphological and growth traits. Rapid establishment is necessary in order to provide the performance of a mature turf cover in the shortest time possible. The aims of the research were: (1) to determine variation of growth, morphological and biomass traits in bermudagrass accessions belonging to different phenotypic groups during establishment and (2) to relate such variations to establishment speed in order to assess whether contrasting phenotypic traits could induce different establishment patterns in bermudagrass or if a general establishment predictor can be identified for …

Monitoring road pavement performance through a novel data processing approach, accelerated pavement test results

2020

This research presents a novel performance-based interpretation method for continuous monitoring of pavement condition through the use of piezoelectric sensors. The objective of this study is to validate the compressed cumulative loading event approach, implemented in a previously developed piezoelectric sensor, for detecting subsurface fatigue cracking through full-scale accelerated pavement testing. A piezo-electric film of polyvinylidene fluoride is used to harvest the microstrain energy induced by the traffic loading at the surface. Epoxy is used to protect the sensor following a H-shape packaging. Piezoelectric sensors were exposed to approximately 1.0 million load repetitions between …

Direct synthesis of C3-mono-functionalized oxindoles from N-unprotected 2-oxindole and their antileishmanial activity.

2014

A novel approach for the synthesis of unprecedented C3-mono-functionalized indolin-2-ones is reported, starting from 2-oxindole and chalcones. The reactions proceed regioselectively under mild conditions, without di- and tri-alkylated side products. The new compounds have been evaluated in vitro for their antiproliferative effects against the protozoan Leishmania infantum. Interestingly, they appear able to kill L. infantum promastigotes and amastigotes, without significant cytotoxic effects.

Estonian e-Residency: a model for Europe

2020

This paper aims to examine one of the main implications of freedom of establishment: since it is possible to transfer a company abroad effortlessly, in fact, governments are adopting various strategies to make themselves more attractive. These are based on two main directives: first, a convenient tax system, as in Malta, on the other side technology, as proposed in Estonia. These countries’ strategy is radically different: Malta offers an extremely profitable tax system, while Estonia, on the other side, is the only nation in Europe where the optimal use of technology and its potential allows the consolidation and implementation of a totally digital system, whose advantages outweigh those o…

Is it “impossible to will to be punished?” Exploring a consensual way out of the Kantian dilemma

2017

In the Metaphysics of Morals Kant wrote that “it is impossible to will to be punished”. The main goal of the present paper is to challenge this idea. In contemporary literature, a similar challenge was attempted by assigning a pivotal role to the notion of ‘consent’. Therefore, focused on these antecedents, what I will try to do in this paper is to determine whether the notion of consent is capable of playing any role whatsoever in a justificatory theory of punishment.
