The migrant crisis in the Mediterranean Sea: Empirical evidence on policy interventions

Abstract This paper presents a novel set of empirical evidence to explore several hypotheses regarding the migrant crisis in the Mediterranean Sea. The political instability in transit countries, such as Libya, that made pre-existent repatriation policies ineffective, called for several search-and-rescue operations in the Mediterranean, which in turn have been wrongly accused of fostering illegal immigration and increasing deaths at sea. The empirical results show that the main determinants of the departures are several root causes at the departing African countries, underlining the importance of fighting human smuggling networks. Maritime search and rescue operations are critical missions involving personnel, boats, helicopter, aircrafts in a struggle against time often worsened by adversary sea and weather conditions. In such a context, telecommunication and in- formation systems may play a crucial role sometimes concurring to successfully accomplish the mission. Il contributo introduce lo special Issue "Il lato oscuro del diritto nella criminalizzazione del soccorso in mare" sottolineando come le ricostruzioni e le riflessioni poste in essere in questa raccolta di contributi possano almeno contribuire a descrivere le dinamiche e a porre in evidenza i pericoli intrinseci nello spazio di arbitrio che il lato oscuro del diritto schiude. Argomenta inoltre perché ciò sia possibile proprio a partire dal contesto tanto specifico quanto urgente preso in considerazione, poiché nel Mediterraneo centrale la lotta per il diritto, spesso giocata proprio a partire dai chiaroscuri delle norme, si traduce ogni giorno in vite perdute o vite salvate.

this contribution traces the main stages of the process of criminalization of non-governmental organizations' search and rescue activities in the Central Mediterranea Sea, to light the paradoxes and the shadows. The theoretical framework is that of the civil disobedience and its counterpart, the obligation to obey the law. This perspective, emblematic for investigating complexity, limits and potential of the law itself, has been used because it can bring out the specificity of the positions assumed by the main players involved in the events, as well as the legal and socio-cultural consequences of their actions, by interrogating the dimensions of legality and justice.
