The Norwegian National Day (17 May, also referred to as Constitution Day) stands out as one of the most popular National Day celebrations in Europe. According to surveys, around seven out of every 10 Norwegians take part in a public celebration during this day. This means that the National Day potentially has an impact on the way people reflect upon national identity and its relationship to the Lutheran heritage. The essay intends retrace the development of the relationship between secular reason and religious language in Habermas's thought. To this end, the essay focuses on the theory of translation, and on complementary learning. The first part will provide a comparison between the conception of modernity and the progressive promotion – on both a cognitive and normative level – of the religious sense. The second part advances an interpretation of the public sphere conceived as a secular space for the cooperation between reason and religion. Lastly, the article highlights the problematic excess of the religious sense by considering the rationalization of its semantic contents.

The Role of Nature in the Secularization of Criminal Law in Europe (17th–19th Centuries)

Some authors have argued that enlightenment authors endorsed a social contract that was not compatible with the existence of laws of nature or a moral foundation for criminal law, while nineteenth-century liberal criminal lawyers founded criminal law upon a natural law theory, based on divine commands. This chapter demonstrates on the contrary that enlightenment authors did not necessarily make a sharp distinction between morality and criminal law, nor did 19th-century criminal lawyers adopted a conception of criminal law that was too heavily dependent on morality, as it was defended by medieval and early-modern-age scholars. The limits of subtractive politics: Agamben and Rousseau’s inheritance

The article critically engages with Giorgio Agamben’s reading of Rousseau in order to explore the affinities between the two authors’ subtractive approach to political subjectivation. In The Kingdom and the Glory. Agamben argues that Rousseau’s Social Contract reproduces, in a secularized manner, the providential paradigm of government, whose origins Agamben finds in early Christianity. This paradigm establishes a fictitious articulation between transcendent sovereignty and immanent government, presenting particular acts of government as emanating from general divine laws. The period between 2001 and 2015 brought two events in Poland that deserve to be called phenomena. In 2001 the rightist, clericalist League of Polish Families entered the Sejm. Ten years later, the leftist, anticlericalist Palikot Movement achieved spectacular success in the 2011 elections. These events give a picture of a radical shift in the Polish political scene: a rightist clericalist party disappeared from the right flank of the political scene, while a new, leftist-anticlericalist formation appeared. The relation between state and Church is one of the main topics of Western political debate. In this essay I will stress that there is not a clear formula to face this topic. Therefore, it is necessary that Catholic philosophy and theology always reflect on the way this relation has to be thought as time goes by. More specifically, I will argue that the premise of liberal Catholicism, that is that a clear distinction between state and society exists, is today not more easily acceptable at all. This point is very important in order to reflect upon the relation between state and Church, political and religion, and public and private sfere in our age.
