La botte piena e la moglie ubriaca, ovvero: i limiti del positivismo giuridico di Bruno Celano

This paper proposes a critical analysis of Bruno Celano’s normative legal positivism. The main objections focuses on four crucial points of Celano’s theory: 1) the distinction between descriptive and normative jurisprudence, which is not taken in due account; 2) the underestimation of the role of interpretation in the legal domain; 3) the acritical acceptance of the source thesis; 4) the attempt of reconciling a procedural ideal of the Rule of Law with the substantial values of the contemporary constitutional States.

La storia della Sicilia greca è scandita, nei suoi momenti chiave, dalla persistente presenza dell’immagine del Dinomenide Gelone. Questo lavoro analizza le valenze paradigmatiche assunte dalla sua figura nella memoria civica siracusana e nella produzione storiografica; inoltre ricostruisce le dinamiche politiche che hanno spinto i principali tiranni siracusani (da Dionisio I a Ierone II) a stabilire un confronto con Gelone. This work analyses the paradigmatic value taken on by his figure in the civic memory of the people of Syracuse and in historiographic production. It also reconstructs the political dynamics which pushed the principal tyrants of Syracuse (from Dionysius I to Hiero II) to establish comparisons with Gelon. His exemplum was used to legitimate political actions and commitment against the Carthaginianparticular attention was also given to the Library of History of Diodorus Siculus and the role that the figure of Dinomenid assumes in itregarding these aspects the work of this author seems to have sometimes the signs of a personal interpretation of history: one that cannot always be explained in relation to the use of the two principal sources for Western history Timaeus and Philistos.

Il testo prende in esame il complesso di materiali editi e inediti (fonti storiche e archivistiche, documenti musicali, testimonianze etnografiche) che attestano la presenza del tarantismo in Sicilia dalla metà del Seicento alla fine dell’Ottocento. Il caso siciliano viene quindi inquadrato nell’ambito dell’ampia letteratura che ruota intorno al fenomeno, a partire dal classico studio di Ernesto De Martino fino al dibattito sull’interpretazione del fenomeno fra i poli dell’esorcismo e della possessione, dovuto soprattutto all’etnomusicologo francese Gilber Rouget. Settore L-ART/08 - EtnomusicologiaThe text examines published and unpublished materials – such as historical and ethnographic sources archive records and musical documents – which testify the presence of tarantism in Sicily from mid-17th century to the end of the 19th. The Sicilian case is then considered in a wider context of contributions on the theme starting from the ‘classic’ De Martino’work up to the debate on the interpretation of the phenomenon between the poles of exorcism and possession chiefly rased by French ethnomusicologist Gilbert Rouget. The analyses is therefore expanded to the tradition of snakes bites healers (the ciaràuli) which shares with tarantism the spider symbolism and to certain kinds of religious processions characterised by frantic ‘dances’ which suggest elements of functional continuity with tarantism musical-choreutic therapy.

After a short account about the state of the research on Pseudo-Hegemonius Adversus Haereses, the author focuses on the present condition of the text and makes his considerations on the genesis of the booklet as the result of a translation, here and there quite literal, from probably one Greek source, perhaps from a heresiological synthesis in Greek that was not preserved. From that point of view, some decisions taken by former editors are perhaps worth to be reconsidered, such as a conjecture that seems to become superfluous.

Glossing the Old Frisian Psalter: Pragmatics and Competence

The essay takes into examination the interlinear glosses in Old Frisian in the fragment of Psalter in ms. Groningen, Universiteitsbibliotheek 404. This is the oldest medieval Frisian fragmentary codex to survive and contains verses of Psalms XVII, XXVII, and XVIII, accompanied by glosses in the vernacular. This essay is the first lengthy study specifically devoted to the typology of the glosses themselves and their peculiarities (within the field of interlinear glosses). On close inspection, the OF glosses show a large internal coherence and individual quality. As a logical and direct consequence of the closure of schools and sports facilities, an expected reduction in the practice of physical activity (PA) and sports has been detected in both children and adolescents all over the world. Hence, we analysed the short-term and long-term consequences of the lack/low level of PA and sports activity in this population, which we referred to as primary and secondary risks, respectively, the latter of which have to be considered in hypothetical future scenarios.
