Transnational Organized Crime and European Union: Aspects and Problem
2013
The fight against criminal organisations and their ability to carry out illegal activities beyond national systems has represented a “bridge head” in the European path towards the harmonisation of criminal laws in the Member States. After identifying the role of the harmonisation of criminal law in the European Union Treaties, the study underline that the difficulty in defining the concept of transnational organised crime could lead to a too wide European intervention. In order to avoid such a risk, it is useful to refer to other relevant international sources, like the 2000 Palermo UN Convention. Nevertheless, the more recent European decisions on the matter (in particular, a Resolution by…
European Union directives and clinical practice in nursing education in the Nordic countries
2019
Nursing education in countries belonging to the European Union (EU) must follow EU directive requirements. The aim of this opinion paper is to explore and discuss the challenges presented by EU requirements to clinical practice in nursing education. These requirements prescribe that clinical practice must be carried out in a variety of different and specialized areas that provide care in hospital units. This may offer students only a limited range of experience; thus, they may not be fully prepared to care for patients with common diseases, and only have a restricted knowledge about the ongoing development of caring for patients at home. EU directives require that half of a nursing educati…

2003
SUMMARY The international trade law passes through a crisis of legitimacy following the inequitable character of its rules and the irrelevance of its principles to the peculiarities of the North-South relations. Being the legal translation of the capitalist free market economic system, these rules are to protect the mercantile and free trade values. In order to overcome this crisis the movement of fair trade has emerged and has since its origin been supported by members of the international civil society. Fair trade means taking into account the standard of living and the conditions of employment of the marginalized producers in developing countries so as to improve them. This study is an a…

The Infra-Constitutionality of European Law in Romania and the Challenges of the Romanian Constitutional Culture
2016
This article deals with European Law as a legal transplant facing the Romanian constitutional culture, in the context of constitutionally limiting the Romanian State’s sovereignty as a member of the EU. Consequently, the reception of the EU law into the Romanian constitutional system (and culture) is determined by two paradoxically divergent Romanian legal-cultural traits: on the one hand, the necessity (bearing accents of national legal pride) to cherish and fructify the Romanian legal (constitutional) traditions, reified, as I shall denominate, as ‘the adapted Romanian law’, and stipulated in the 2003 amended Constitution as a ‘tradition firewall’ / ecran de traditionalite. On the other h…

2016
