Which Foundation for Human Rights?

The article argues the thesis according to which the problem of the foundation of human rights is not well formulated in the classic debate on it. The reason is that there are different kinds of foundations, depending on the different concepts of human rights, but also in consideration of the different aspects of their practice. The question is then which foundation fits with a notion of human rights as a legal and social practice. The second part is dedicated to the analysis of the idea that the practice of human rights is part of the current jus gentium. It aims at showing the implications of that relationship in terms of their appropriate legal grounds.

After the territorial unity of Italy in 1861, romanists, ethnographers and musicologists addressed their efforts in collecting poems and folk music, aiming to demonstrate the interconnection among different regions. At the end of the nineteenth century, the impulse to identify the unity of the country through dialects became a dogma, in order to consolidate the unachieved “Italianness”. Alongside to this presumed linguistic similarity, an obsessive mix of nationalism and irredentism provoked the political campaign, which brought to the war in 1915. The work focuses on the case of the nomad camp of Palermo, in southern Italy, where three groups of “Gypsies” have been living for twenty-five years, in ghetto-like conditions. This camp represents a world outside the city, or rather a confined microcosm, with, except for volunteer workers, sporadic contact with the people of the city or the public administration. . This means that there is no inter-relationship between the camp and the outside world. Il tema leibniziano della società degli spiriti, ovvero di quelle anime razionali che, in quanto capaci di accedere alle verità eterne, si rendono simili a Dio, il tema comunitario del Dio che, proprio in ragione di questa affinità, stringe con gli altri spiriti una società, ripropone per certi versi il motivo classico del legame tra polis e amicizia. Tale motivo conosce però, nel disegno leibniziano di una società degli spiriti, uno slancio nuovo, che si lega alla figura di un Dio non autoreferenziale, di un governante che nel governato riconosce il principio a partire dal quale, solo, si rende visibile la sua stessa bontà.
