L’articolo tratta del delicato e complesso concetto di abuso del diritto, nato nel campo del diritto civile e poi approdato in sede penale nel settore del diritto penale tributario. Nell’articolo si ritiene che tale nozione non è compatibile con i princìpi fondamentali del diritto penale italiano e che, pertanto, non vi dovrebbe avere ingresso.

The article deals with the delicate and complex concept of abuse of law born in the field of civil law and then landed in criminal law in the field of criminal tax law. Progetto di restauro, per la fruizione e la valorizzazione della chiesa di San Domenico

The essay illustrates the methodological process used to analyze the state of conservation and accessibility issues of the church of San Domenico in Palermo, built from scratch from the 17th century. XVII, on medieval pre-existences. Furthermore, the essay presents a proposal for the restoration and accessibility of the church itself, where there is a difference in height between the floor of the church and that of the square of several steps. The research was conducted within the Restoration and Theory and History of Restoration Laboratory and involved the students of the LM4 course in Architecture of the Palermo Department. Progetto di restauro, per la fruizione e la valorizzazione dell’Oratorio del Santissimo Rosario in San Domenico

Il saggio illustra l’iter metodologico utilizzato per l’analisi dello stato di conservazione e delle problematiche di accessibilità presenti nell’Oratorio del Santissimo Rosario in San Domenico di Palermo, edificata nel sec. XVII, e caratterizzato da notevoli opere d’arte e ricco delle decorazioni realizzate, con stucco, da Giacomo Serpotta nel sec. XVIII. Il saggio presenta l’iter metodologico utilizzato per l’analisi dello stato di conservazione e delle problematiche di accessibilità presenti nella chiesa di San Sebastiano di Palermo, edificata alla fine del sec. XV. Inoltre nel saggio si mostra una proposta di restauro e di accessibilità alla stessa chiesa che nel passato aveva un sagrato eliminato dopo la metà del Novecento (e i danni subiti dai bombardamenti della seconda guerra mondiale) per raccordare i livelli della strada. Grounded Analytic Research: Building Theory from a Body of Research

Track II: Recent Developments in Inductive Research Methods; International audience; In this paper, we present Grounded Analytic Research (GAR) as a method to build theory by synthesizing empirical findings from multiple studies that has been conducted by a single researcher. GAR incorporates concepts from grounded theory, analytic research and systematic literature review. The method was applied in a doctoral dissertation work to build the theoretical concept of Demand Sustainability of public Internet access in the context of bridging the digital divide. We describe GAR and compare it with existing theory building methods that are similar to it in epistemology and ontology.

Erosion of universal health coverage in Spain

Whereas the recent UN resolution urges governments to accelerate progress towards universal access to affordable and quality health-care services, the Spanish Government, bypassing the parliamentary procedure, enacted a Royal Decree to limit access to free services at the point of delivery for all-undermining the principle of universal coverage. Spanish health and social service budgets have been subjected to large cuts (13,7% in 2012 and 16,2% in 2013) with some regions imposing additional budget cuts.
