L’articolo analizza le modifiche operate dal disegno di legge n. 2427/2020 (“Nuove norme in materia di illeciti agro-alimentari”) sui delitti del c.p. contro la salute pubblica e sugli illeciti alimentari della legge n. 283/1962. Si evidenziano profili di incoerenza sistematica e un deficit di coordinamento tra i due distinti piani di tutela. In primo luogo, non è chiara la demarcazione tra le fattispecie delittuose di cui all’art. 5 della legge n. 283/1962 e i delitti codicistici contro la salute pubblica.
