The Substitutability of Unfair Contract Terms in Credit Agreements Denominated and Indexed to Foreign Currencies

This contribution deals with the problem of the capacity of the court to replace the unfair term in the loan agreements with a supplementary provision of national law. The main aim of the contribution is to confirm the thesis, that the court is not entitled to change the condition for which it states that it is unfair despite the conscious and fixed will of the consumer himself. We have used formal – dogmatic approach for this text.
A comparative statistical analysis between the italian local banks, the effects of the financial crisis on funding and credit policies

This work intends to carry out a comparative statistics between Italian banks (both co-operative banks that banks) about their economic and corporate profiles in the period immediately before (2006-2007) and in the immediate aftermath (2008- 2011) to the international financial crisis. In this way, we will try to investigate whether the global economic shock caused any differences between these banks in their funding policies, credit policies.

A simple model of income, aggregate demand and the process of credit creation by private banks

This paper presents a small macroeconomic model describing the main mechanisms of the process of creation by the private banking system. The model is composed of a core unit-where the dynamics of income, credit and aggregate demand are determined-and a set of sectoral accounts that ensure its stock-flow consistency. Early studies testing the quiet life hypothesis in banking found strong evidence that banks in more concentrated markets exhibit lower cost efficiency levels. More recent studies have reexamined the issue in different contexts, with mixed results. These approaches are based on stipulating a linear re- lationship between market power and efficiency in banking, which might be problematic, as suggested by the literature on efficiency analysis. A reply to "banking crises, labor reforms, and unemployment: A comment"

Aleksynka (2015) points to some important methodological flaws in the labor market indicators data used in Bernal-Verdugo, Furceri and Guillaume (2013) [BFG]. This paper revisits the empirical findings presented in BFG, and shows that the results and conclusions are little affected by these methodological flaws. In particular, we find that: (i) while in countries with more flexible labor markets the impact of banking crises is sharper but short-lived, in countries with more rigid labor markets the effect is initially more subdued but highly persistent; (ii) comprehensive labor market reforms have a positive impact on unemployment, albeit only in the medium term.
A network perspective on international banking integration

Abstract The aim of this article is to develop new international banking integration indicators together with their components: openness and regularity (balance) of the bilateral bank flows. We define the Standard of Perfect Banking Integration (SPBI), which characterizes the scenario attainable when bank flows are not geographically biased, and cross-border asset trade is not affected by home bias. We assess the gap between a hypothetical scenario of geographic neutrality and the current level of banking integration, along with both of its components. Determinants of Banks’ Profitability: Evidence from EU 27 Banking Systems

Abstract In this study we assess the main determinants of banks’ profitability in EU27 over the period 2004-2011. We split the factors that influence bank profitability in two large groups: bank-specific (internal) factors and industry specific and macroeconomic (external) factors. We consider as proxy for banks profitability the return on average assets (ROAA) and the return on average equity (ROAE). The empirical findings are consistent with the expected results. Banking Accounting between Prudence and Flexibility

Abstract This paper is about the first year applying the International Financial Reporting Standards in Romanian banking accounting system. The research goal is revealing the effects on valuation of assets, liabilities or risks provisions. Expected results are linked to changing of performance indicators. Besides the need of specific resolution measures, the crises revealed the necessity to adopt prudential regulations for increasing banking accountability. Similar to the other segments of the financial market, the facts have shown that the control over the obeisance of these regulations should be entrusted to a supervising authority.
