A Victim of a Road Traffic Accident Not Fastened by the Seat Belt and the EU Motor Insurance Law: CJEU Judgment in Vítor Hugo Marques Almeida

This case note relates to the recent judgement (23 October 2012) by the Court of Justice of the European Union in the case No C-300/10 concerning interrelation of the European Union motor insurance law and the national civil liability regulation. As the civil liability arising from motor traffic accidents is not approximated by the European Union law, its regulation falls within the national law. Yet, application of the national civil liability law shall not undermine the obligation to provide insurance coverage for victims of road traffic accidents. When trade unions succeed: Cases of blocked liberalisation in the common market

Despite the generally accepted weakness of trade unions at the European Union level, an analysis of two high profile cases - the Services Directive and the Port Directive - shows that trade unions are able to mobilise effectively at the European level and, within constellations of actors, crucially impact EU decision making. In contrast to common claims that a lack of access to EU institutions makes such groups powerless, it is argued here that the exclusion of large opposing societal groups from consultations is neither a quick nor a sure fire recipe for dismantling opposition.On the contrary,it politicises the process and may lead to opposing groups mobilising in more contentious ways.

Abstract The current article discusses the changes in the role of the European Association for Quality Assurance in Higher Education (ENQA) in the Bologna Process, mainly from the ENQA point of view. Export Price Discrimination in Europe and Exchange Rates

The paper studies pricing-to-market behavior on a wide range of disaggregated European Union exports to OECD countries. The sample allows better identification of products for which such behavior is pervasive. The results suggest that the degree of markup adjustment in response to exchange rate changes is similar across destination markets. The evidence of pricing-to-market across source countries ranges from 40% (Netherlands) to 63% (Germany) of the products in the sample, except for the United Kingdom, where there is remarkably little evidence of it. However, formal comparisons across source countries by product do not usually reveal differences in behavior.

This article deals with the decision taken by the Court of Justice of the European Union in Sofina. In the authors' view, it may have extended the standard of comparability, requiring (foreign) non-dividend income of the recipient to be taken into consideration in comparing the tax treatment of domestic and outbound dividends. This comparator, however, upsets the principle of territoriality, as accepted by the Court in Futura (Case C-250/95) and Centro Equestre (Case C-345/04), by requiring the source state to take into account losses that the non-resident taxpayer has in the residence state. PESI - a taxonomic backbone for Europe

Reliable taxonomy underpins communication in all of biology, not least nature conservation and sustainable use of ecosystem resources. The flexibility of taxonomic interpretations, however, presents a serious challenge for end-users of taxonomic concepts. Users need standardised and continuously harmonised taxonomic reference systems, as well as highquality and complete taxonomic data sets, but these are generally lacking for nonspecialists. The solution is in dynamic, expertly curated web-based taxonomic tools. The Laotian Rock Rat Laonastes aenigmamus Jenkins, Kilpatrick, Robinson & Timmins, 2005 was originally discovered in Lao People's Democratic Republic in 2005. This species has been recognized as the sole surviving member of the otherwise extinct rodent family Diatomyidae. Laonastes aenigmamus was initially reported only in limestone forests of Khammouane Province, Central Lao. A second population was recently discovered in Phong Nha Ke Bang National Park (PNKB NP), Quang Binh Province, Central Vietnam in 2011. Comparative economic analysis of support policies for solar PV in the most representative EU countries

Abstract The purpose of this paper is to study the positions of some European Union (EU) countries on the development of PV systems. After a review of the main support policies for PV systems in Europe, the specific situations of five representative countries (France, Germany, Greece, Italy and the U.K.) are examined, with the purpose of describing the main differences in their implementation of support policies adopted for PV systems.
