Legal aspects of forensic DNA analysis in Germany
1997
DNA analysis may be carried out in cases of civil law (e.g., in cases of disputed paternity) as well as of criminal law (e.g., a case of murder). This overview will concentrate on DNA analysis in the context of criminal law. DNA typing of forensic stain samples is generally carried out in laboratories of the Police and of University Institutes of Legal Medicine. The police laboratories are usually part of the State Criminal Offices (Landeskriminalamt, LKA) or of the central Federal Criminal Office (Bundeskriminalamt, BKA). Each of the sixteen German Federal States (except one) has a LKA with a department carrying out forensic stain analyses. The 25 Institutes of Legal Medicine belong to the…
Sulla specificità del ragionamento giuridico. L'analogia nel civil e nel common law
2014
2022
The creation of a trust during separation and divorce proceedings is part of the trend known as “privatization” of family law. The commitment to create a trust taken during a marriage separation process before the judge is nowadays very common. However, if this commitment is not followed by a proper notarial deed, the trust cannot be considered as having come into existence and therefore any action for nullity addressed towards this “commitment” can only be rejected
Codification of the civil law in the 19th century United States
2021
“A code, or not a code—that is the question!”. Many countries asked themselves that very question. In the United-States that question was asked during the American codification movement, and answered, in chronological, with the civil codes of Louisiana from 1808, 1825; the Code of Georgia from 1862; the Revised Civil Code of Louisiana of 1870, the Civil Code of California of 1872, the Civil Code of Dakota Territory of 1872, the Revised Code of North Dakota of 1895, the Civil Code of Montana of 1895, and the Revised Code of South Dakota of 1903. One other civil code in is the Field Civil Code, also called the 1860 Project of Civil Code for the state of New York. Even though it was never adop…
2015
The article focuses on the German Civil Code and its translations into Polish. After it came into force in 1900, the Civil Code was also binding in the western parts of contemporary Poland until it was repealed by a unified Polish Civil Code after the Second World War. Selected usual word combinations in the German civil law have been analysed, in order to check whether their Polish counterparts are still usual in the Polish legal language. Therefore the article deals with a question which according to Lombardi’s opinion (2007: 119) is a desideratum research.
The role of the agreement as a tool for management of property relations in cases of cross border marriages and civil unions/partnerships registered …
2021
The essay examines the role of the agreement as a tool for managing property relationships in crossborder marriages and registered partnerships, in light of EU Regulations 1103 and 1104 of 2016, on the property regimes of international married or registered couples. The main prerogative of such acts is the recognition of the parties? freedom to choose the court and the applicable law. The law governing the matrimonial property regimes, or the property consequences of registered partnerships, has universal scope. This agreement in the form envisaged, which is backed by the need for legal certainty and predictability of the applicable rules, means that the spouses, in family problems which ha…
