Nel contributo in oggetto l'autore, muovendo dalla decisione delle Sezioni Unite della Cassazione n. 61 del 7 gennaio 2014, coglie l'occasione per riesaminare le vecchie e nuove problematiche sottese all’intervento dei creditori nel processo esecutivo. Il primo tema affrontato è quello della par condicio creditorum, che viene esaminata nella sua storia evolutiva dal Code Napoleon, al suo periodo di massima estensione, dato dal codice del 1940, fino al suo ridimensionamento a seguito delle riforme del 2005. It concludes however that a revolution like the aforesaid explained would be only apparently advantageouOld and new problems related to the intervention of creditors in the expropriation (marginal notes at Cass. Sez. Un. January 7 2014 n. 61) Moving from the decision of the Sezioni Unite n. 61/2014 the author takes the opportunity to re-examine old and new problems related to the intervention of creditors in the forceable execution. The first major theme concerns par condicio creditorum which is examined in its evolutionary history since the Code Napoleon through its period of maximum extension (the Code of 1940) until its reduction as a result of the reforms of 2005. The author examines the possibility to overcome quoad effectum the distinction between sine titulo et cum titulo interveners in light of jurisprudence’s evolution between 1978 2009 and 2014. The possibility in particular concerns those creditors sine titulo the where credit has not been contested (ex art. 499 c.p.c.) by the debtor seek payment and partecipate to distribution. In the last section the author examines the possibilities for other creditors to contest the intervention of the creditor sine titulo ex art. 499 c.p.c. (utendo iuribus in subrogation in case of inaction of the debtor) or in the distribution phase ex art. 512 c.p.c. He concludes that the only person that will be really damaged if he doesn’t contest - ex art. 499 c.p.c. - the credit it is precisely the debtor. Revision of asterolepidoid antiarch remains from the Ogre Formation (Upper Devonian) of Latvia

The Frasnian (Upper Devonian) antiarch Walterilepis speciosa was first described in 1933 (as Taeniolepis) on the basis of a single specimen. The newly collected material has allowed the head to be described in a more detail, especially the nuchal and paranuchal plates. Other newly described elements include bones of the pectoral appendages and trunk armour, demonstrating a rather high and short trunk armour. The shape and proportions of the head and trunk armour suggest the attribution of Walterilepis to the family Pterichthyodidae; it is most probably closely related to Lepadolepis from the Late Frasnian of Germany. Sponges (phylum Porifera) live in a symbiotic relationship with microorganisms, primarily bacteria. Until now, molecular proof for the capacity of sponges to recognize fungi in the surrounding aqueous milieu has not been available. Here we demonstrate, for the demosponge Suberites domuncula (Porifera, Demospongiae, Hadromerida), a cell surface receptor that recognizes (1--3)-beta-D-glucans, e.g. curdlan or laminarin. This receptor, the (1--3)-beta-D-glucan-binding protein, was identified and its cDNA analysed. Sella, A NEW NAME FOR THE GENUS Linaresia EL KADIRI, 1992 (NASSELLARIA, RADIOLARIA) PREOCCUPIED BY COPEPOD CRUSTACEANS (LAMIPPIDAE, MAXILLOPODA)

The aim of this short note is to create a new name of this genus since the original name Linaresia proved to pre-exist in the paleontological literature ( Linaresia de Zulueta, 1908, Family Lamippidae, Copepod crustaceans, and Linaresia Gonzalez-Donoso, 1968, Family Gavelinellidae, Agglutinated Foraminifera). The new name created for the above mentioned radiolarians is: Sella . This name derives from an arbitrary combination of letters (International Code of Zoological Nomenclature). The type species of Sella is S. beniderkoulensis by original designation (El Kadiri, 1992).

A long-snouted late Eifelian arthrodire from Aragon (Spain)

Carolowilhelmina geognostica Carls, 1995 is a large arthrodire (Placodermi) from the Tortodus kockelianus Conodont Zone, late Eifelian, in the Eastern Iberian Cordillera in southern Aragon. The somewhat incomplete but articulated skull is preserved, showing a long tubular rostral plate, very small postnasal plates, low toothless inferognathals, and a small, slender and flat parasphenoid. Supraorbital and central sensory lines meet their antimeres at the midline of the skull, forming a straight double line.
