The essay deals with the informed consent to allow or to refuse medical treatment for pediatric patients, in a comparative law perspective. The article scrutinises the main narratives adopted by the E.U., the U.S. and China in the fight for digital sovereignty. It analyses the ongoing dialogue between legal systems that is taking place in the digital sphere to ponder on the role of comparative law in this dialogue. With legal systems called to apply a territorial law to a global phenomenon, comparative law proves to be a fundamental tool in the dispute for digital sovereignty, widely employed across legal formants, with a critical role in creating a distinctive identity for the legal systems.

The purpose of this essay is to reframe the conceptual division between rights and remedies by identifying those issues that are generally raised in the legal discourse when dealing with the two perspectives. The focus will be particularly on: policies that govern rights and remedies, judicial discretion, and judicial interpretation. While the traditional account based on a sharp opposition of rights and remedies proved to be untrustworthy, the proposed conceptualization helps to outline the distinction in a more realistic way.

The vast majority of Spaniards is in favor of a constitutional reform. Before the undertaking of this reform, there are some previous conditions that need to be granted: a rational debate on ideas; a reduction of the political and social tension; a common goodwill to reach a consensus; and some loyalty during negotiations.
