La presente tesis plantea un problema ciertamente recurrente en el contexto del funcionamiento de las administraciones públicas, que se manifiesta en términos de realidad, cuando un funcionario investido de potestad administrativa, adopta una decisión a efectos establecer una solución frente a una situación concreta, amparándose para la expedición de la medida en un concepto amplio, vago, abstracto, impreciso o ambiguo, que no permite contornos conceptuales definidos, pues no admiten una cuantificación o determinación rigurosa y la única forma de ser precisado, es mediante su aplicación material.
