Right for conciliation and family welfare

2015

By enhancing some of the solutions proposed in a previous study on female work and family needs, the essay focuses on the role of family as a privileged forum to reconcile family plans and professional careers. The research aims at proposing a convergence of social family policies (macro-choice) and the choices shared among individual family members (micro-choice). The article, therefore, examines the policies carried out by some European states to support families and the different models of social support to the family in Europe, including the one that has recently inspired the Job's act in Italy. Through a (re) reading of some constitutional principles on the family social factor and an …

DAL «JOBS ACT» AL «DECRETO DIGNITÀ»: OSSERVAZIONI CRITICHE SULLA PROROGA DEL CONTRATTO A TERMINE

2019

The article analyses the extension of the term in the fixed-term contract in the framework of Legislative Decree n. 81/2015, both before and after the changes enacted by the l. n. 96/2018 (so-called Decreto Dignità, Dignity Decree). It lacks a specific rule concerning the form that the extension’s agreement has to have. Therefore, the author outlines the reasons why the written is required for the validity of such a deal. Moreover, this, especially in the cases where the term’s extension does not require a justification. That conclusion comes from a systematic interpretation of the rules established by the articles 21 ff., of the Legislative Decree no. 81/2015. Consequently, because the wri…

Undeclared, informal, and precarious workform "social pollution" to “decent work” trough “nonwage security tax”

2015

The paper, basing on a multidisciplinary literature, considers flexicurity as any balance between flexibility and security and, therefore, proposes ordering any set of work-relationship, providing the same balance and with the same regulatory framework, in “communities”. It is assumed, therefore, that communities can differ either in terms of a “protective” trade-off, where the differential is not a surrogate measure of security, or in terms of an economic trade-off, where it is met by the provision of social insurance or security. One of these sets is called community 0 and it corresponds to undeclared work, not only illegal (e.g. informal), but also completely devoid of security and fully…
