The author deals with three unknown and mysterious Egyptian papyri (Pap. Lond. iii, 1164 h, BGU iv 1157, P. Oxy xvii 2136), which are dated from the i b.C. to the iii a.d. His idea is that these documents prove the use of the contract of misthoprasia for the fulfillment of the munera for the annona. He demonstrates that this papyri contain a sort of long-term agreement, used to optimize the liturgical public service.

Il contributo ridiscute criticamente, sulla base dei dati desumibili dalle fonti, i vari tentativi di ricostruzione delle formule delle azioni divisorie sinora proposti. Nel concentrarsi in particolare sulla impossibilità di accettare la proposta ricostruttiva di Lenel, si nega che che la 'demonstratio' con cui si apriva il programma di giudizio potesse risolversi nell'enunciazione, in un costrutto assertorio introdotto da 'quod', della richiesta di un giudice, dovendo invece rinviare, come le altre 'demonstrationes' a noi note, alla 'causa actionis'.

The present work deals with D.19.4.1.1, text in which Paul seems to grant an actio in factum pretoria (Gai 4.66) in favour of the contractor evicted within a relationship of barter, with a solution that not generally seemed consistent with the decision taken elsewhere by the same jurist (Paul. D. 19.5.5.1) to allow a civil action for the hypothesis of non-execution. Many have therefore assumed that Paul was referring someone else's opinion (maybe by Salvio Giuliano) from him not shared, with a proposal though hardly sustainable.
