The study deals with Julian's thought on the protection of innominate contracts. In this regard, the idea is widespread that the jurist was opposed to an enlargement of the contractual sphere beyond the figures recognized at the edictal level. This conviction is based primarily on Ulp. 4 ad ed. D. 2.14.7.2, well-known testimony in which Julian is reprimanded by Maurician and Ulpian for having granted an action in factum about a case of eviction, for which, according to both jurists his successors, he could have acted with the actio civilis incerti. Among the problems long debated by the scholars of the Greek Paraphrase of Justinian’s Institutes, the most interesting was the one concerning the legal sources used by Theophilus; they indeed are not identical with Justinian’s Institutes. Furthermore, a point of view prevails that claims the Antecessor – during the editing of his Paraphrase – could also have taken into consideration Gaius’ Institutes. My speech is based on a close analysis of a well-known passage (Theoph. 2,10 pr. concerning the definition or etymology, ὅρος ἤτοι ἐτυμολογία, of testamentum) and it aims to re-examine how Theophilus managed his sources. J.C. Maier – a previously known aide to Bluhme in the transcription of the Veronese palimpsest of Justinian’s Code. This paper calls into question the idea that in the summer of 1823 Maier worked together with Bluhme at the decipherment of the palimpsest of Gaius’ Institutes preserved in the Capitular Library of Verona (Verona, B. Cap., Cod. XV). A comprehensive analysis of the sources leads to the conclusion that Maier helped Bluhme in the same library for the transcription of the palimpsest of Justinians’ Code (Verona, B.
