CLAUSOLE VESSATORIE, NULLITÀ DI PROTEZIONE E POTERI DEL GIUDICE: ALCUNI PUNTI FERMI DOPO LE SENTENZE JŐRÖS E ASBEEK BRUSSE

2013

The paper takes the recent cases Erika Jőrös (Case C- 397/11,) and Asbeek Brusse,(case C-488-11), both dated 30 may 2013, as a starting point for a more general analysis of the ECJ’s approach to the legal consequences to be drawn by a national Court from finding that a contractual term is unfair. According to the Author, the approach adopted by the Court is the same that it has already been expressed in Mostaza Claro case. By revisiting the earlier Océno, the Court clarified that national courts have not only the right but even the duty to assess the fairness or unfairness of standards terms of their own motion. Well, beginning from Mostaza Claro judgement and until the last ones, the ECJ h…

A note on fair value accounting in a crisis: The influence of the hedge accounting regulations

2010

Published version of an article published in the journal: Business and Economics Journal. Also available from the publisher at: http://astonjournals.com/manuscripts/Vol2010/BEJ-13_Vol2010.pdf The role of fair value accounting in the financial crisis is contorversial and heavily debated. Some claim that fair value accounting of financial instruments contributed to the recent crisis. This note acknowledges that, in many industries, a significant proportion of the financial instruments are entered into for hedging purposes. I examine if a crisis through the hedge accounting regulations, can affect the overall use og fair value accounting in an economy. I present analytical evidence that the bo…

Leksiski stilistiskie līdzekļi Dž. R.R. Tolkīna garastāstā Kalējs no Lielās Vutonas

2017

Šajā darbā tiek pētīti leksiskie stilistiskie valodas izteiksmes līdzekļi Dž.R.R Tolkīna fantāzijas novelē Kalējs no Lielās Vutonas.

Students’ Opinions on Financial Compensation from Project Work

2015

Project-based learning with real customers arguably offer value for all stakeholders. This value has been discussed in literature both from the viewpoint of customers and the related economic value, and the enhanced learning of students. This paper presents the results from an empirical study on students who have completed a multidisciplinary project course with real customers. A qualitative survey was focused on how students see the value of project-based learning and whether there should be financial compensation to students. The students placed a higher value on learning than financial compensation, and while they argued that it would be fair and nice if some compensation was paid, they …

TV-theatre: TV Presence in Contemporary Theatre for Children and Young Audiences in Buenos Aires

2009

In Argentina, television shows have created their own theatrical shows, which run for the winter holidays, using the same stories, same characters, and same actors but onstage. Many artists who devote themselves all year long to theatre for children see those “TV-theatre” shows as unfair competition, arguing that such huge productions lack actual artistry and cultural value. This paper aims to examine the characteristics of the TV-theatre, including how much theatre and how much TV languages, codes, and messages it contains, using Pavis´s concept of “intermediality.” If one of theatre for children's greatest goals or outcomes is to create future audiences/theatregoers, and to impart in them…

Simulation-Based Performance Study of e-Commerce Web Server System – Results for FIFO Scheduling

2013

The chapter concerns the issue of overloaded Web server performance evaluation using a simulation-based approach. We focus on a Business-to-Consumer (B2C) environment and consider server performance both from the perspective of computer system efficiency and e-business profitability. Results of simulation experiments for the Web server system under First-In-First-Out (FIFO) scheduling are discussed. Much attention has been paid to the analysis of the impact of a limited server system capacity on business-related performance metrics.

No…
