L'affitto d'azienda nel fallimento

La proposta esegetica del presente lavoro si articola su due livelli. Sul primo, l'affitto endofallimentare è visto come strumento di riallocazione del rischio di impresa nell'insolvenza, dai creditori al terzo affittuario, e di ripristino del fisiologico rapporto tra potere gestorio e business risk, tipico dell'impresa in bonis. Sul secondo, l'istituto è inquadrato non come anomalia sistematica, ma come coerente momento di valorizzazione della massa attiva da liquidarsi, in una mutata concezione della fase liquidatoria fallimentare, necessariamente integrante un momento gestionale che, per la res azienda, coincide con la continuazione dell'impresa.

Background and Purpose. To determine the construct and predictive validity and sensitivity of the sub-scale items for postural changes, sitting balance and standing balance of the Postural Control and Balance for Stroke (PCBS) test over a 90-day follow-up. Method. In the initial phase of stroke the PCBS test scores were compared with values obtained for the Barthel Index (BI) and the four neuropsychological domains most widely studied in the literature: memory; language; visuo-spatial functions; and visual inattention. Exploiting historical rainfall and landslide data in a spatial database for the derivation of critical rainfall thresholds

Critical rainfall thresholds for landslides are powerful tools for preventing landslide hazard. The thresholds are commonly estimated empirically starting from rainfall events that triggered landslides in the past. The creation of the appropriate rainfall–landslide database is one of the main efforts in this approach. In fact, an accurate agreement between the landslide and rainfall information, in terms of location and timing, is essential in order to correctly estimate the rainfall–landslide relationships. Is the ad hominem argument a fallacy or not? In this paper I will try to demonstrate that an ad hominem is not intrinsically fallacious and that the speaker’s personal convictions, commitments and actions are deeply involved in every argument. This paper starts with a comparison between dialectical and rhetorical approaches to the argumentation, and, in particular, to the agreement. Briefly: from a dialectical standpoint, the argumentation is aimed at resolving a difference of opinion or a disagreement.
