The ‘margin of appreciation’ in echr case-law as a boundary line to legal transplants

2015

This study investigates the influence of the European Human Rights Court on State 'margin of appreciation' on the diffusion of accepted or rejected cultural and political choices through the jurisprudence of the case-law. The margin of appreciation is aninterpretative argument, a criterion, a parameter, which allows the Court to preserve rather than censure national State policies and choices on difficult issues which, involving moral and ethical questions, and which do not receive common answers in the ,European legal systems. The work considers some decisions of the Court on abortion, ovum donation, pre-implant embryo analysis and artificial procreation techniques, to find out if, in such…

Law and glocalization

2022

The chapter intends to analyze the existing relationship between, law, globalization and grobalization. Having briefly illustrated the key concepts of globalization and grobalization, in order to examine the above relationship the chapter analyzes first the concepts of hybridity, mixity and diffusion as used in comparative law, in order to determine to which extent the same concepts as used in legal sociology cannot create misunderstandings. After having clarified all the key elements for the analysis, then the chapter focuses on how globalization and grobalization intersect with law, putting forward some related examples. The chapter ends with some conclusive remarks.

MR3785684 Reviewed Liu, Ai Fang(PRC-NAA); Li, Peng Tong(PRC-NAA) K-fusion frames and the corresponding generators for unitary systems. (English summa…

2018

Given an operator K∈B(H), in this paper the authors introduce K-fusion frames as a generalization of fusion frames, defined as a sequence {Wi} of closed subspaces of the Hilbert space H. For K=1, this becomes a fusion frame. They prove some properties of K-fusion frames, based on considering the operator K and the frame operators. In the last section, for a unitary system U, the authors define a K-fusion frame generator in a way similar to the frame vectors for unitary systems. Some properties and characterization theorems are derived for operators in the generalized local commutant of U.

In vitro evaluation of the antibacterial activity of cured dentin/enamel adhesive incorporating the antimicrobial agent MDPB

2010

The aim of this study was to investigate in vitro the antibacterial effect of a dentin/enamel adhesive containing MDPB (Clearfil Protect Bond) after curing and to compare it with an adhesive not containing MDPB (Clearfil SE Bond). The antibacterial effect of the cured adhesives was tested on Enterococcus faecalis by the evaluation of growth inhibition in a 48-h microplate direct contact test (DCT). The presence of antibacterial activity due to soluble components was also investigated by an agar diffusion test (ADT) performed with the adhesives cured on the surface of dentin disks. In the DCT, both the tested materials showed complete inhibition of bacterial growth until the 7-h reading, reg…

Italian daily platelet transfusion practice for haematological patients undergoing high dose chemotherapy with or without stem cell transplantation: …

2016

Background. Following high-dose chemotherapy/bone marrow transplantation, patients are routinely, prophylactically transfused with platelet concentrates (PC) if they have a platelet count ≤10×109/L or higher in the presence of risk factors for bleeding. However, whether such transfusions are necessary in clinically stable patients with no bleeding, or whether a therapeutic transfusion strategy could be sufficient and safe, is still debated. Materials and methods. The GIMEMA Haemostasis and Thrombosis Working Party sent a questionnaire to Italian haematology departments to survey several aspects of daily platelet transfusion practice, such as the cut-off platelet count for transfusion, the e…

Diffusion modeling of COVID-19 under lockdown

2021

Viral immune evasion by sequence variation is a significant barrier to severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) vaccine design and coronavirus disease-2019 diffusion under lockdown are unpredictable with subsequent waves. Our group has developed a computational model rooted in physics to address this challenge, aiming to predict the fitness landscape of SARS-CoV-2 diffusion using a variant of the bidimensional Ising model (2DIMV) connected seasonally. The 2DIMV works in a closed system composed of limited interaction subjects and conditioned by only temperature changes. Markov chain Monte Carlo method shows that an increase in temperature implicates reduced virus diffusi…
