This article explores methodological problems of qualitative research templates, that is, the Eisenhardt and the Gioia case study approaches, which are relevant for the business and society (B&S) scholarship and outlines a reflexive historical research methodology that has the potential to face these challenges. The corporate social responsibility promise is a fascinating one: companies are able and willing to regulate themselves, and self-regulation is manifested in collaborative efforts that promote individual well-being. Yet, this macro-level promise has a silenced flip side in organizational contexts. The purpose of this article is to analyse the differnt civil process of the Civil Procedure Law that can be used for the recovery of illegally occupied properties: eviction for precarious, injunction to recover possession and action action for the protection of registered property rights. Special attention is paid to the new procedure of rapid recovery of possession that has been created by Law 5/2018 amending the classic injunction to regain possession.
